For appellants : Sh. Nitin Thatai, Advocate For respondent No.1 : Sh. Kapil Khanna, Advocate For respondents No.2&3 : Ex parte First Appeal No.315 of 2019 2 RAJINDER KUMAR GOYAL, PRSIDING MEMBER :
The matter has been compromised between the parties.
Learned counsel for appellants has made the following statement:-
"That the matter has been settled between the appellants and respondent No.1 and the appellants are ready to refund the amount of Rs.37,500/- to the respondent No.1 and the appellants wishes to withdraw the above said appeal in lieu of settlement arrived at between the parties, subject to that the executions filed by respondent No.1 would be withdrawn as full and final settlement has been arrived. Remaining amount of Rs.12,500/- deposited by the appellant in the present appeal be refunded to the appellants along with interest accrued on the total deposited amount."

2. On the other hand, learned counsel for respondent No.1 has made the following statement:-

"That the matter has been settled between the appellants and respondent No.1 and the appellants are ready to refund the amount of Rs.37,500/- to the respondent No.1 and the appellants wishes to withdraw the above said appeal in lieu of settlement arrived at between the parties, The executions filed by respondent No.1 would be withdrawn as full and final settlement has been arrived".

3. In view of the statements of counsel for appellants and respondent No.1. The appeal is dismissed as withdrawn, as the matter has been fully satisfied.

4. Amount of Rs.50,000/- was deposited by the appellants in this case. Amount of Rs.37,500/- be remitted to respondent No.1/complainant and remaining amount along with interest which has accrued thereon, if any, shall be remitted by the registry to the First Appeal No.315 of 2019 3 appellants/opposite parties No.1&2, whosoever deposited, by way of a crossed cheque/demand draft after the expiry of 45 days of the sending of certified copy of the order to it.

5. The appeal could not be decided within the statutory period due to heavy pendency of court cases.
