The CPIO vide letter dated 03-03-2022 forwarded the RTI application to the Director, Department of Employment and Training, Lucknow, U.P., for providing requisite information or inspection report of Jagdish Prasad Private ITI, Jaunpur, UP directly to the appellant. In compliance of this, the CPIO Department of Employment and Training, Lucknow, vide letter dated 02-06- 2022 provided information containing three pages. Further, the CPIO furnished a point-wise reply to the Appellant on 30.09.2022stating as under:
क आवेदक (हररहर प्रसाद दसंह) द्वारा रदजस्टडथ डाक के सूचना इस संस्र्ान से सम्बल्कित नही माध्यम से प्रेदित प्रार्थना पत्र ददनां दकत- 12-10-2021 है ।
जो श्रीमान् डायरे क्टर जनरल एन०सी०वी०टी०, नई ददल्ली को संबोदित है । उपरोक्त प्रेदित प्रार्थना पत्र ददनां दकत-12-10-2021 श्रीमान् श्रीमान् डायरे क्टर जनरल एन०सी०वी०टी०, नई ददल्ली के कायाथ लय में कायथरत दकस कमथचारी द्वारा दकस ददनां क को प्राप्त दकया गया। प्रार्थना पत्र प्राप्त करने वाले उस कमथचारी के नाम व पद सदहत सूचना उपलब्ध कराने की कृपा करें ।
ख आवेदक द्वारा प्रेदित प्रार्थना पत्र ददनां क-12-10-2021, सूचना इस संस्र्ान श्रीमान् डायरे क्टर जनरल एन०सी०वी०टी०, नई ददल्ली से सम्बल्कित नही के कायाथलय में प्राप्त होने के पश्चात् दकस कमथचारी है । द्वारा दकस ददनां क को श्रीमान् डायरे क्टर जनरल महोदय के समक्ष प्रस्तुत दकया गया तर्ा श्रीमान् जी द्वारा उस पर क्या आदे श पाररत दकया गया। पाररत आदे श की प्रमादर्त छायाप्रदत सदहत सूचना उपलब्ध कराने की कृपा करें ।

च Baba Jagdish Chandra ITI College, College in सम्बल्कित संस्र्ान Maniyarepur, Uttar Pradesh 222129 Jagdish Prasad द्वारा दकरायनामा 10 Private ITI (2364) Jaunpur Basic Info ITI, Code (SCVT): विथ के लीज पर 2364, ITI Code (DGT): Pro 9000406, ITI Email: iti 2010 दलया गया र्ा, उसी jaunpur @ gmail. com, Contact No. : 9005546555, के आिार पर Fax:, Web Site: iti 2010 jaunpur@ gmail, com, Year सम्बल्कित संस्र्ान of Establishment: 2012, Division Name: Joint को मान्यता प्राप्त Director (Varanasi), के Name & Style में मान्यता प्राप्त 5 करने के समय भूदम/जमीन से संबंदित दकस ग्राम का हुआ र्ा, अदभलेख पत्रावली में संलग्न दकया गया र्ा। पत्रावली दकरायानामा के में संलग्न उस ग्राम की भूदम/जमीन से संबंदित एग्रीमेन्ट समाप्त होने के पश्चात पुनः अदभलेख/कागजात की प्रमादर्त छायाप्रदत सदहत ददनां क 06 मई सूचना उपलब्ध कराने की कृपा करें । 2022 से अगले 03 विों के दलये नवीनीकरर् कराया गया हैं । शपर् पत्र संलग्न है ।
Being dissatisfied, the appellant filed a First Appeal dated 23.11.2022. The FAA vide its order dated 19.12.2022, held as under:-
"The Appeal of Mr. Harihar Singh was considered in detail and it has been found that the information sought in point a) to b) as enumerated above falls under the purview of personal information i.e. Section 8(j). The disclosure of the information sought would lead to invasion of privacy and has no connection with public interest or activity.
It has been held in the Supreme Court Judgment tiled "Girish Ramchandra Deshpande v. CIC, (2013) 1 SCC 212 that-:
"The performance of an employee/officer in an organisation is primarily a matter between the employee and the employer and normally those aspects are governed by the service rules which fall under the expression "personal information", the disclosure of which has no relationship to any public activity or public interest. On the other hand, the disclosure of which would cause unwarranted invasion of privacy of that individual."
In reference to query e), it is stated that as per public records, the Annexure III of the application form submitted at the time of affiliation specifically mentioned that Jagdish Prasad Industrial Training Centre, was located in the village Chandwak. That the RTI Applicant did not provide specific detail and code no. in reference to the Baba Jagdish Chandra ITI College, hence no information can be provided pertaining to the above. The concerned Public 6 information Officer can only provide information that is part of the public authority.
Similarly in query f) it is again reiterated that the Annexure III of the Application from submitted at the time of affiliation specifically mentioned that the concerned ITI (Jagdish Prasad Industrial Training Centre) was located in the village Chandwak. It is stated that no information can be provided in reference to the Baba Jagdish Chandra ITI College, in absence of the specific detail and code no. The copy of the Annexure III of the application form is attached herewith."
Feeling aggrieved and dissatisfied, appellant approached the Commission with the instant Second Appeal.
Relevant Facts emerged during Hearing:
The following were present:-
Appellant: Absent Respondent: Shri Harish Chander CPIO Dy. Director, National Council for Vocational education &Training, New Delhi (Respondent No. 1) appeared in person and Shri Amrit Pal Singh, CPIO and Joint Director, T.C Section, DG, Khaushal Bhawan (Respondent No. 2) appeared in person.
The respondents while defending their case inter alia submitted that they had already provided point-wise replies to the RTI application and the first appeal as per the records available with them vide letters dated 03-03-2022, 02-06- 2022, 30-09-2022 and 19-12-2022.
The respondent No. 2 (PIO of Government Industrial Training, Jaunpur) vide letter dated 30.09.2022 stated that information sought on points (a) to (d) was not concerned with their department. As regards point (e) and (f) of the RTI application, they replied that affiliation to Baba Jagdish Chandra College was provided on the basis of lease deed executed between Mr. Harihar Singh and Mr. Pradeep Kumar Jaiswal. The Affidavit in respect to the execution of the lease deed was also provided by them.
As regards point Nos. (a) and (b) of the RTI application, the respondent No. 1 stated that information sought pertained to third party, therefore, they claimed exemption under section 8 (1) (j) of the RTI Act. Besides, they informed that available information has been provided to the appellant.7
Decision:
The Commission after adverting to the facts and circumstances of the case, hearing the respondent and perusal of the records, notes that point-wise replies were given by the respondents vide their letters dated 03-03-2022, 02- 06-2022, 30-09-2022 and 19-12-2022. Perusal of the records revealed that the respondents had denied the information on point Nos. (a) and (b) of the RTI application on the ground of third-party information and claimed exemption under section 8 (1) (j) of the RTI Act.
It may not be out of place to mention that information regarding receipt of his representation dated 12.10.2021 and action taken thereon cannot be considered as third-party information. Therefore, exemption claimed by the respondent was not sustainable in the eyes of law. Besides, no reply was given against point Nos. (c) and (d) of the RTI Application. Further, it is noted that the respondent has duly replied on point Nos. (e) and (f) of the RTI application as per the records available with them.
In view of the above, the respondents are directed to revisit the RTI application and provide specific point-wise information/reply against points (a) to (d) of the RTI application as per the provisions of the RTI Act, within three weeks' time from the date of receipt of this order. The respondent is at liberty to invoke section 5 (4) of the RTI application in case the information sought pertained to different department/office.
The appeal is disposed of accordingly.
