Section 94(3) in The Maharashtra Irrigation Act, 1976
(3)makes any dam or obstruction for the purpose of diverting or opposing the current of a river or canal on the bank whereof there is a flood-embankment or refuses or neglects to remove any such dam or obstruction when lawfully required so to do;shall, when such act shall not amount to an offence of committing mischief within the meaning of the Indian Penal Code, on conviction, be punished for each such offence with fine which may extend to one thousand rupees, or with imprisonment for a term which may extend to one year or with both, and in the case of a continuing offence, with an additional fine which may extend to fifty rupees for every day during which such offence continues after conviction for the first such offence.
