Background
1. The Order given by the Commission on 31.12.08 in the above case is as follows:
i) With reference to the above mentioned letter from Hotel Janpath dated 7.2.08 to CPIO, ITDC, the Commission directs the CPIO ITDC to update the website and to upload all rules, regulations, manuals etc. within one month of receipt of this Order to ensure compliance with the Section 4(i)(b) of RTI Act and to send compliance report to the Commission with a copy to the Appellant.
2. The Complainant complained that the decision of the Commission was not complied with and requested the Commission to initiate necessary action against the officer who has mislead the Commission by giving false information.
3. The Complainant was present during the hearing.
4. Ms. Mamta Rana, Asst. Mgr cum deemed PIO and Mr.Manjeet Singh AM(L) cum nodal officer represented the Public Authority.
5. The Complainant stated that the so called HRA Rules downloaded from the Hotel Janpath website are not rules that he is seeking. The Respondent, however, maintained that they are the only rules available and are the ones being followed by ITDC, The Government's HRA Rules downloaded from the website were produced before the Commission by the Appellant. It was noted that although one month had passed full compliance with Section 4(1)(b) of the RTI Act has not been undertaken. The Commission gives one more opportunity to the Respondent to comply with Section 4(1)(b) and to produce a compliance report before the Commission by 15 June, 2010. The report to be handed over personally by the PIO to the Deputy Registrar Mr. G Subramanian.
