(G.R. Case No. 960 of 2016) And In Re: Sk. Monowar Ali @ Sk. Manuyar Ali @ Manu ... ... Petitioner Mr. Suman Chakraborty ... ... for the petitioner Ms. Zareen N. Khan ... ... for the State The petitioner is seeking bail in connection with a case relating to offence punishable under Sections 341/323/325/379/506/34 of the Indian Penal Code, 1860 and Sections 25/27 of the Arms Act.
It is submitted on behalf of the petitioner that the petitioner is in custody for 18 days and further detention of the petitioner is not necessary in the facts of the instant case.
Learned Counsel for the State produced the case diary and opposed the prayer for bail.
Having considered the materials in the case diary and bearing in mind the nature of the offence and the period of detention of the petitioner, I am of the opinion that further detention of the accused/petitioner is not necessary for progress of investigation. 2
Therefore, the accused/petitioner, namely Sk. Monowar Ali @ Sk. Manuyar Ali @ Manu, be released on bail upon furnishing a bond of Rs.5,000/- (Rupees Five thousand only), with two sureties of Rs.2,500/- each, one of whom must be local, to the satisfaction of the learned Additional Chief Judicial Magistrate, Arambagh, Hooghly, subject to condition that the said petitioner shall meet the Investigating Officer once a week for a period of three months or till filing of the charge-sheet, whichever is earlier .
The application for bail, thus, stands allowed.
