The petitioner, apprehending arrest in connection with West Port Police Station FIR No. 108 of 2015 dated 11.05.2015 under Sections 406/407/120B of the Indian Penal Code, has come to this Court for anticipatory bail.
Heard the learned counsel appearing on behalf of the parties. At the very outset, the learned counsel for the State in his usual fairness submits that he has very carefully gone through the case diary but could not find any incriminating materials so far collected against the petitioner.
We have also gone through the case diary. We find no reason to take a different stand.
Having regard to above, the prayer for anticipatory bail stands allowed.
2Accordingly, it is directed that in the event of arrest, the petitioner shall be released on bail to the satisfaction of the arresting officer upon furnishing a Bond of Rs.5,000/- on condition that after release, he shall surrender before the court concerned within four weeks thereafter.
This order is subject to the conditions laid down in sub-section (2) of Section 438 of the Code of Criminal Procedure.
The application for anticipatory bail, is, thus, disposed of.
