Bhattacharyya ... for the petitioners Mr. Madhusudan Sur Mr. Dipankar Paramanick ... for the State allowed It is submitted on behalf of the petitioners that there is a free fight between the victim and the petitioners and there are case and counter case between themselves.
Learned counsel for the State opposes the prayer for bail. Having considered the materials in the case diary and keeping in mind the nature of allegations in the light of the aforesaid submissions made on behalf of the petitioners and the nature of injuries as transpiring from the medical papers, we are of the opinion that this is a fit case to grant anticipatory bail to the petitioners.
Accordingly, we direct that in the event of arrest, the petitioners shall be released on anticipatory bail upon furnishing bond of Rs.10,000/-(Rupees Ten Thousand only) each with two 2 sureties of like amount each, to the satisfaction of the arresting officer and also subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, 1973.
The application for anticipatory bail is, accordingly, allowed.
