This petition under Article 226/227 of the Constitution of India is for issuance of writ in the nature of mandamus for directing respondent No. 3 to register marriage of the petitioners as the petitioners are major.

The petitioners have solemnized marriage on 06.05.2013. The petitioners are major as the date of birth of petitioner No. 1 is 24.09.1989 and petitioner No. 2 is 10.09.1998 (P-2 and P-1). The petitioners approached this Court and this Court vide order dated 08.05.2013 directed the Sr. Supdt of Police, Ferozepur to protect the life and liberty of the petitioner and take appropriate action in accordance with law on application dated 06.05.2013. However, when Arora Gaurav 2014.01.24 16:32 I attest to the accuracy and integrity of this document CWP No. 642 of 2014 (O&M) -2- petitioners appeared before the Tehsildar-cum-Marriage Registrar on 25.10.2013 in connection with registration of their marriage, responded No. 3 asked the petitioners to come along with parents of petitioner NO. 1. The petitioners also gave representation dated 28.11.2013 along with a copy of High Court order dated 08.05.2013 but no action has been taken on it till date.

As per Rule 5 and 6 of the Hindu Marriage (Punjab) Registration Rules, 1960, for registration of the marriage there is no requirement that the parents should be present at the time of registration of the marriage as they are major.

This petition is being disposed of by giving a direction to respondent No. 2 to pass necessary orders, in accordance with law on the representation (P-7), expeditiously.
