1. Learned counsel for the parties state that the matter has been settled between the parties and the parties have decided to file a joint petition under Section 13(b) of the Hindu Marriage Act, 1955, subject to the payment of `1,50,000/- by the applicant-wife to the respondent. The applicant undertakes to make the payment of `50,000/- on the date of the institution of the petition under Section 13

(b) of the Act and the remaining amount of `1,00,000/- shall be paid at the final motion. The applicant shall also withdraw the civil suit (Annexure P-1) on the next date of hearing and the respondent shall withdraw H.M.A. No. 36/16.10.2010 titled as Pawan Kumar Vs. Arti TA No.248 of 2011 2 Sharma (Annexure P2).

2. In view of the agreement reached between the parties, the present application has been rendered infructuous and the same is dismissed as such.

3. The parties shall remain bound by the undertaking given by them before this Court.
