05/17.01.2025 Mr. Pradeep Kumar Nayak has appeared on behalf of opposite party no.2, Mr. Naresh Prasad Thakur has appeared on behalf of opposite party no.3 and Mr. Ajay Kumar Singh has appeared on behalf of opposite party nos. 5 to 8. Notice upon proposed legal heir/successor of opposite party no.1 has been received by his sister and in view of that, notice upon proposed legal heir/successor of opposite party no.1 is deemed to be validly served.
2. I.A. No.11110 of 2023 has been filed for substitution of legal heir/successor of deceased opposite party no.1.
3. Learned counsel for the petitioner submits that opposite party no.1 has left for his heavenly abode on 19.10.2023 and the name of his legal heir/successor is disclosed in paragraph 3 of the said I.A. -1- C.M.P. No. 323 of 2023
4. Considering that the notice upon proposed legal heir/successor of opposite party no.1 is deemed to be validly served, the prayer made in the said I.A. is allowed.
5. Learned counsel for the petitioner will make out necessary correction, in course of the day.
6. Accordingly, I.A. No. 11110 of 2023 is disposed of.
7. Issue notice upon opposite party no.4 by ordinary process as well as registered post with A/D, for which, requisites etc. shall be filed within a week.
