FACTS

This matter is fixed for hearing on 21.9.2012. However, Shri A. K. Sharma, Dy. Secretary (CPIO) and Shri Parmeshwar Toppo, Jt. Director (Pers.) of DVC are present before the Commission today dated 19.9.2012. On their request, they are heard today so that they do not have to visit Delhi again.

2. The matter, in short, is that the appellant's father was an employee of DVC, (since retired). The appellant's mother, who was recipient of the family pension, has also expired. In the RTI application dated 8.11.2011, the appellant had sought a copy of the Relinquishment Certificate purportedly containing his signatures, alognwith that of the members of his family.

3. This information was denied by the CPIO on the ground that the appellant was seeking third party information. Hence, the present appeal.

4. Shri Sharma justifies his decision.

5. The appellant appears before the commission on 21.9.2012. He is heard. It is main contention is that he is the son of deceased Surendra Singh and can not be treated as 3rd party. He pleads for supply of Relinquishment Certificate.

6. Suffice to say that the appellant claims to be the son of the deceased employee Shri Surendra Singh. If it is true, then, the appellant cannot be treated as third party and the information cannot be denied to him. Hence, I find it difficult to uphold the order of the CPIO and the same is set-aside. The CPIO is hereby directed to provide a copy of the Relinquishment Certificate to the appellant subject to the condition that he would satisfy the CPIO that he is the son of deceased Surendra Singh.

7. This order may be complied with in 05 weeks time.
