Section 14 in The Estates Partition Act, 1897

14. Interest alienated with special condition as to liability for land-revenue.

- No proprietor who has alienated any portion of his interest in an estate, or in any specific land of an estate, by private contract, with the condition that the transferee shall be liable in respect of the interest acquired by him to pay a specified amount or a specified share of the land-revenue for which the estate is liable (such amount or share being other than the proportionate amount or the proportionate share for which such transferred interest if formed into a separate estate would be liable under Section 10);and no proprietor who has derived his title from any proprietor who has made any alienation as aforesaid;shall be entitled to claim a separation under this Act of the interest which he continues to hold in the estate;and no such transferee as aforesaid, and no person deriving his title from such a transferee, shall be entitled to claim a separation of the interest which has been so acquired:Provided that a separation of such interests may be made if the parties concerned agree-
(a)to waive the conditions of the contract as regards the proportion of land-revenue for which the transferor and transferee or their representatives respectively are liable, and
(b)to hold the estates which may be allotted to them respectively by the partition subject to the payment of such amount of land-revenue as may be assessed upon them respectively under this Act.
