1. This matter is taken up through hybrid mode.

2. Heard learned counsel appearing for the Parties.

3. It is contended that even though Petitioner initially was engaged as a guest faculty, but vide order dtd.04.09.2010 under Annexure-4 series, he was engaged on contractual basis.

4. It is contended that in terms of the office order dtd.04.09.2010 so issued under Annexure-4 series, Petitioner though is continuing on contractual basis as on date, but no step is being taken by Opposite Party No.3 to regularize the services of the Petitioner.

5. Mr. S.N. Nayak, learned counsel appearing for the Sri Jagannath Sanskrit Viswavidyalaya on the other hand contended that unless and until required permission is accorded by the Government, services of the Petitioner cannot be regularized.

5.1. It is also contended that pursuant to the advertisement issued by the University on 30.07.2015 under Annexure-5, though Petitioner applied in the selection process, but he was not allowed due to overage. However, it is fairly contended that Petitioner is continuing on contractual basis in terms of the order issued under Annexure-3 and the interim order passed by this Court on 17.05.2017.

Having heard learned counsel appearing for the Parties and considering the submissions made and the fact that Petitioner is continuing on contractual basis in terms of the order issued under Annexure-4 series, this Court permits the Petitioner to make an appropriate application for regularization of her services before Opposite Party No.3.

6.1. It is observed that if any such application is moved before Opposite Party No.3 within a period of fifteen (15) days from today, Opposite Party No.3 shall take a lawful decision on the same after taking required permission from the Government-Opposite Party No.1 within a period of four (4) months from the date of receipt of this order. Till a decision is taken as directed, interim order passed by this Court on 08.10.2015 shall continue.

7. Accordingly, the Writ Petition stands disposed of.
