04.03.2025 This is an application filed under Section 384 of the Indian Succession Act, 1925 read with Order XLI Rule 5 of the Code of Civil Procedure, 1908 seeking stay of the judgment dated Page No.# 5/6 04.11.2024 passed in Misc. (Succession) Case No.5/2022 by the Court of the District Judge, Morigaon.
2. Issue notice making it returnable on 04.04.2025.
3. The applicant is directed to take steps upon the respondent Nos.1 to 9 way of registered post with A/D as well as through usual process within 3 days.
4. In addition to that, the applicant is further directed to effect service upon the respondent Nos.1 to 9 by way of dasti routed through the Registry of this Court and file an affidavit of service on or before the next date.
5. This Court has perused the impugned judgment dated 04.11.2024 passed in Misc. (Succession) Case No.5/2022 by the Court of the District Judge, Morigaon. From a perusal of the said judgment, it is seen that the succession certificate has been issued in favour of the respondent No.1.
6. Taking into account that the accompanying Appeal has already been admitted vide the order dated 05.02.2025, this Court is of opinion that the impugned judgment dated 04.11.2025 passed in Misc. (Succession) Case No.5/2022 by the Court of the District Judge, Morigaon is required to be stayed pending notice.
7. Accordingly, the impugned judgment dated 04.11.2024 Page No.# 6/6 passed in Misc. (Succession) Case No.5/2022 by the Court of the District Judge, Morigaon is stayed till the next date.
8. List accordingly.
