Petitioners - Vinod Kumar and 27 others, working as Data Entry Operators, with respondent Dakshin Haryana Bijli Vitran Nigam, Hisar, at various places, have approached this Court by way of filing the present writ petition under Articles 226/227 of the Constitution of India, with a prayer for issuance of a direction to the respondent to release the arrears of salary from the period September 2015 to September 2018, which according to them have been reduced by the respondents arbitrarily. They had further seeking a direction to the respondents to pay them pay the bonus with arrears alongwith interest thereon from the date of joining of the petitioners till the date of payment.
According to the petitioners, they had submitted written representations to respondent No.1, copies thereof being Annexures 1 of 2 ::: Downloaded on - 28-08-2021 02:02:29 ::: CWP No. 16717 of 2021 -2- P-5 and P-6, dated 13.2.2019 and 17.12.2020, respectively, without evoking any response, as such they have filed the present writ petition.
Notice of motion.
At this stage, Ms. Shubra Singh, Additional Advocate General, Haryana, has accepted notice on behalf of the respondents.
Learned counsel for the petitioners submits that the petitioners would be satisfied if a direction is issued to such respondents to consider and dispose of their representation(s), within a fixed time frame.
Learned State counsel appearing for the respondents states that any such order passed by this Court shall be duly complied with.
Accordingly, the present writ petition is disposed of with a direction to respondent No.1 to look into the representations of the petitioners (Annexures P-5 and P-6) and to take necessary action in the matter, in accordance with law, if it is so warranted by the facts and circumstances of the case. A speaking order in that regard be passed within a period of two months from the date of receipt of a copy of this order.
In case the petitioners still feel dissatisfied after disposal of the representation by respondent No.1, then they may take recourse to the legal remedy again, in accordance with law.
