Section 26(3) in The U.P. Judicial Service Rules, 2001
(3)Candidate recruited to the service may lose his seniority if he fails to join the service without any valid reasons when a vacancy is offered to him within the prescribed time or the extended period, as the case may be. The decision of the appointing authority shall be final in this regard.
