Section 40(1) in The West Bengal Primary Education Act, 1973
(1)If by such date, as may be fixed by the State Government in this behalf, any of the authorities fails to elect a member or members as provided in [section 37 or section 38] [Words and figures substituted for the words and figures 'section 37, section 38 or section 39' by W.B. Act 47 of 1980.], the State Government shall appoint member or members qualified for election by such authority.
