2 06-07-2017Heard Sri Binod Kumar, learned counsel for the petitioner.
No one appears for the State.
The petitioner in the present case is seeking regular bail in connection with Dumaria P.S. Case No. 24/2013 registered for offences punishable under Sections 147, 148, 149, 353, 324, 307, 332, 333, 120(B) of the Indian Penal Code, Sections 3 / 4 of the Explosive Substances Act and Section 17 of the C.L.A. Act.
Learned counsel for the petitioner referring to the First Information Report would submit that the name of the petitioner has been mentioned in the F.I.R. on mere suspicion which will be evident from a reading of the same. Altogether 13 persons have been named in the F.I.R. Similarly situated accused have been granted regular bail by co-ordinate bench of this Court Patna High Court Cr.Misc. No.28525 of 2017 (2) dt.06-07-2017 2/2 in Cr. Misc. No. 48126/2015 and Cr. Misc. No. 9676/2017. Learned counsel would further submit that although as many as five cases are mentioned in Paragraph 3 of the application, however, it would appear that after the year 2003 there was no case against the petitioner but once the petitioner has been involved in this case he has been taken on remand in some other cases as well. He would thus submit that it is a case of false implication.
Considering the facts and circumstances of the case as also the fact that the co-accused in the present case have been granted regular bail by co-ordinate bench of this Court, let the petitioner, namely, Sandeep Jee @ Pradeep Yadav @ Pradeep Jee, be enlarged on bail on his furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Sherghati, Gaya in connection with Dumaria P.S. Case No. 24/2013.
