ORAL ORDER
2 11-10-2012Learned counsel for the petitioners has filed this interlocutory application being IA No 6473 of 2012 with a prayer that this writ application may be disposed of in terms of order dated 30.06.2010 passed in CWJC No 17766 of 2009 and order dated 22.06.2011 passed in CWJC No 719 of 2011.
Heard the learned counsel for the petitioners and the learned counsel for the State.
It appears that the dispute in the present case relates to appointment on Class IV posts in the district of Gaya. Petitioners state that they are similarly situated to the writ petitioners of the aforesaid two writ petitions. Their case is that they were empanelled in the earlier panels prepared but when the present panel was prepared for considering appointment pursuant to Advertisement No 1 of 2004, their names are missing for reasons not disclosed.
Learned counsel for the State having examined the matter has no objection if this writ petition is disposed of in terms of the aforesaid two writ petitions. 6 Patna High Court CWJC No.11384 of 2008 (2) dt.11-10-2012 6/6
In my view, based on the submission of the learned counsel for the petitioners that the case of the petitioners of the present writ petition are similar, let this writ application be also disposed of in terms of order dated 30.06.2010 passed in CWJC No 17766 of 2009 and order dated 22.06.2011 passed in CWJC No 719 of 2011. The District Magistrate, Gaya shall, accordingly, act immediately.
The writ petition stands disposed of at this stage itself.
