Heard through Video Conferencing.
Learned counsel for the applicant submits that despite best efforts so
far made on payment of process fee for service of the respondent, the same
has been avoided by the respondent with ulterior motive. In fact, advocate Binjal Samani has handed over copy of application to the respondent during course of hearing before Micro and Small Enterprises of Facilitation Council at Konkan Region, Thane in Petition No.58 of 2019 instituted by the respondent. Still respondent has chosen not to appear before this Court. Affidavit of the advocate in that behalf is placed as Annexure P-4.
It is submitted that on the one hand, respondent is pressing hard to proceed before the Council as referred above and on the other hand he avoid to appear before this Court.
In the interest of justice, it is considered apposite to order for Dasti service on payment of process fee within three working days and the same shall be construed as the service through official mode.
On payment of PF within three working days, Registry is directed to prepare Dasti notice for service of the respondent and hand it over to counsel for the applicant.
No sooner, service is complete, an affidavit of the person serving the respondent be filed alongwith the service report.
List immediately after receipt of service report.
