Section 35(2) in The Darjeeling Gorkha Hill Council Act, 1988
(2)The Vice-Chairman shall hold office until-(a)he ceases to be a Councillor, or(b)he resigns his office in writing under his hand addressed to the Chairman of the General Council, in which case the resignation shall take effect from the date of its acceptance by the Chairman of the General Council, or(c)his nomination as Vice-Chairman is cancelled by the Chairman of the General Council:Provided that notwithstanding such cancellation of his nomination, he shall, subject to the other provisions of this Act, continue to hold office as a Councillor.
