1. This is an application for condonation of delay in filing the rejoinder.

2. The delay is not opposed by Mr. Manish Sharma.

3. Accordingly, the delay is condoned.

4. The application is disposed of.

5. After some arguments, learned counsel for the parties agree that the captioned petition can be disposed of on the following agreed terms:-

6. Mr. Akhil Sibal (M: 9810340000), learned Senior Advocate is appointed as an Arbitrator in the matter.

7. The learned Arbitrator will be paid a lump sum fees of Rs. 50,000/- to be shared equally by parties.

8. In addition thereto, the learned Arbitrator will be reimbursed expenses, if any, incurred, albeit, on actual basis.

9. The parties will however in the first instance attempt to arrive at a negotiated settlement by appearing before the Mediator appointed by the Delhi High Court Mediation and Conciliation Centre (in short "Centre").

10. Accordingly, parties and their counsel will appear before the Centre on 13.03.2019 at 3:00 pm.

11. The Arbitrator will not enter upon reference till 30.04.2019.

12. In case, further extension is required both parties will make a written request to the learned Arbitrator who will then assess as to whether or not extension is to be given.

13. Needless to say, before entering upon reference, the learned Arbitrator will file a declaration as required under Section 12(5) and other attendant provisions of the Arbitration and Conciliation Act, 1996.
