ORDER
1. The Appellant filed an RTI application dated 22.12.2023 seeking information on the following points:
1. Myself Kalpana K here. We (Pandurangan & Kalpana) took out a home loan from Canfin Bank (Canara Bank Sponsor), Bidadi branch, Bengaluru with the PMAY Home Subsidy Scheme in March 2020 (before the Corona Lockdown began). It has been more than 3 years since I have not received the subsidy. I have been following up on mail with the Pmay office and the relevant branch for almost near 3 years but have not received a satisfactory response. We attempted to check (still checking) the status on the PMAY website, but there also we are experiencing a problem with OTP in that neither of us are Page 1 of 5 receiving any OTPs to our registered phone numbers but we both received an acknowledgement from Ayushman Bharat on Oct 22, 2020, for the successful application generated on the same numbers. So, I kindly request the appropriate individual or team to assist us in this matter on priority by providing the status of our PMAY Subsidy Application ID: C0001717492 (PMAY(U)-CLSS).
Our home loan details are as follows.

2. The CPIO replied vide letter dated 19.01.2024 and the same is reproduced as under :-
"As on 15-01-2024, no record matching the Application ID/Loan Account Number/ Mobile Numbers as provided by the Applicant was found among the claims accepted for processing in the Pradhan Mantri Awas Yojana - Credit Linked Subsidy Scheme (PMAY-CLSS) portal maintained by National Housing Bank (NHB) as a Central Nodal Agency (CNA). Further based on search made with the Application ID/Loan Account Number, a claim was found among the list of rejected cases with the remark "APPLICANT ID ALREADY PRESENT IN UNDER PROCESS/SANCTIONED RECORD", against the upload date 30-10- 2020.

http://pmay-urban.gov.incredit-linked-subsidy-scheme http://nhb.org.in/government-scheme/pradhan-mantri-awas-yojana-credit-linked- subsidy-scheme/ NHB has been identified by the Government of India Ministry of Housing and Urban Affairs (MoHUA), as a Central Nodal Agency (CNA) for implementation of the PMAY-CLSS. The NHB is implementing the Scheme through eligible Primary Lending Institutions (PLIs), which have executed MOUs with NHB, as per the Scheme Guidelines issued by the MoHUA. As per the Scheme Guidelines, the PLI shall be responsible for ascertaining the eligibility of their home loan borrowers, through its due diligence, for availing subsidy under PMAY-OSS and then uploading the eligible subsidy claims on the PMAY-CLSS portal maintained by the CNA. The CNA cannot ascertain the eligibility of the home loan account for subsidy under PMAY-CLSS unless the PLI confirms that the loan is prima facie eligible for subsidy. Further, PLI will follow the best practices of lending to implement the scheme and follow the scheme guidelines and Regulations of Reserved Bank of India/National Housing Bank.
Since the information sought requires drawing of inferences and /or making of assumptions and giving advice or opinion, the NHB has no information to furnish."
3. Dissatisfied with the response received from the CPIO, the Appellant filed a First Appeal dated 23.01.2024 alleging that the information provided was incomplete, false and misleading. The FAA vide order dated 21.02.2024 upheld the reply given by the CPIO.
4. Aggrieved with the FAA's order, the Appellant approached the Commission with the instant Second Appeal dated 10.04.2024.
5. The appellant attended the hearing through video conference and on behalf of the respondent Mr. Rajiv Ranjan, DGM, Mr. Aditya Sharma, DGM, Mr. Gaurishankar, AGM and Mr. Rahul K Meena, AM, attended the hearing in-person.
Page 3 of 56. The appellant inter alia submitted that she had sought status of her PMAY subsidy application to which no proper reply had been furnished by the respondent till date.

The respondent while defending their case inter alia submitted that a response to the RTI application had been furnished to the appellant vide their letter dated 19.01.2024, wherein, available information w.r.t PMAY subsidy along with the web link for general guidelines had been furnished. He stated that the appellant was also informed regarding the rejection of her subsidy application along with the reasons. Hence, no further information remained to be provided.

The Commission after adverting to the facts and circumstances of the case, hearing both parties and perusal of records, observes that a due reply has been given by the respondent vide letter dated 19.01.2024. The Commission notes that the appellant has grievance with regard PMAY subsidy which could be raised before an appropriate forum. This forum may not be treated as grievance redressal forum. However, the appellant has been informed regarding the rejection of her subsidy application along with the reasons. That being so and the reply having been given, there appears to be no public interest in further prolonging the matter. With this observation, the appeal is dismissed.
