                              ORAL ORDER

1. Rule. Mr.R.B. Raval, learned AGP waives service of  notice   of   Rule   on   behalf   of   the   Respondent-State  of Gujarat.

2. The   present   petition   is   filed   by   the   petitioner  under Articles 14, 21 and 226 of the  Constitution  of India as well as under the Bombay Land Revenue  Code   ready   with   Rules   framed   thereunder   for   the  prayers inter alia that appropriate writ, order or  direction may be issued directing the respondent­ Deputy   Collector,   Morbi   to   decide   application  dated  28.07.2014  and also decide the case of the  petitioner   being   Appeal   No.144   of   2013/2014  pending before the Deputy Collector, Morbi on the  grounds stated in the petition.

3. Heard  learned   advocate,   Shri  Y.J.   Patel   for   the  petitioner   and   learned   AGP   Shri   Raval   for   the  respondent.

4. Learned   advocate,   Shri   Patel   stated   that  appropriate   order   may   be   passed   directing   to  decide the appeal within a reasonable time.

5. Learned   AGP   Shri   Raval   on   instruction   has   stated  that the matter is fixed for hearing on 30.03.2015  and still appropriate order maybe passed directing  to decide the said appeal within 2 or 3 months.

6. In the circumstances, the present petition stands  allowed in terms of Para Nos.14((A)  & 14(B).  The  respondent­Deputy Collector, Morbi is directed to  decide   the   case   of   the   petitioner   being   Appeal  No.144   of   2013/2014   within   a   period   of   three  months  from the date of this order in accordance  with law after providing an opportunity of hearing  to all concerned. It goes without saying that the  petitioner shall cooperate in proceeding with the  matter.   Rule   is   made   absolute   to   the   aforesaid  extent. Direct service is permitted.
