COMMON ORDER
(per Hon'ble Dr. Lata Baswaraj Patne, Member(J)) Since the issue involved in all these OAs is similar, all the OAs were heard together and a common order is being passed. However, for the sake of convenience and brevity, the facts and the pleadings mentioned in OA No. 672/2023 are referred to hereunder:
2. The relief sought in OA No. 672 of 2023 is as follows:
"It is humbly prayed that the Hon'ble Tribunal may be pleased to:- (1) Quash and set aside the Impugned Order dt. 01.11.2023 of Respondent No.1 as it is against the letter and spirit of Section 22 sub-section (1) of the Apprentices Act, 1961, but also running contrary to Board letter No. E(NG)II/2016/RR-1/8, dated 21.06.2016 at para 9 and (2) Further direct the Respondent No.1 & 2 to consider the applicants cases for appointment as per their merit list on par with similar situated candidates who applied under CCAAs and appeared for 109th All India Trade Test under Apprenticeship Training Scheme and completed training on or before 12.4.2019 and Trade Theory exam passed after 12.4.2019 and applied for post notified under CEN 01/2019 in various Zonal/ Divisional Railway who have joined respective posts after successfully completing of selection stages irrespective of discrepancy arose vide para 12.2 of centralized notification 1/2019.
(3) On the strength of, clarification issued by the 5th respondent in his letter dated 07.09.2023 and pass such other Order or Orders as deem fit and proper in the interest of principles of natural justice."

It is the case of the applicants that the applied pursuant to the Central Employment Notification No.01/2019, dt. 23.02.2019 for various posts in Level-1 of VII CPC to be filled by Railway Recruitment Cell (for short RRC), SC Railway. The mode of selection is based on a Computer Based Test (CBT), followed by Physical Efficiency Test (PET), followed by medical examination and document verification. Though the RRC, SC Railway allotted 1867 posts for Course Completed Act Apprentices (CCAAs), who underwent training in Railway establishments and possessing National Apprenticeship Certificate (NAC), there was no specific mention about weightage marks allotted to those candidates applied for the vacancies allotted to CCAAs candidates. Date: 2026.03.09 15:47:28+05'30' Foxit PDF Reader Version: 2025.1.0 OA No.020/00672/2023 & Batch in Railway Establishments, shall be given due weightage of marks obtained in their NCVT examination in preparation of final merit list after conduct of Computer Based Test (CBT). It is the case of the applicants that they have completed Act Apprentices in Railway Establishments and having possessed National Apprenticeship Certificate (NAC), have uploaded their marks obtained in NCVT examination in terms of the instructions laid down in the corrigendum dt. 22.07.2022. The respondents further issued one more opportunity to the candidates to upload their marks obtained in NCVT examination. The respondents also clarified that those candidates who applied for CCAA vacancies are exempted from appearing from PET examination. All the applicants appeared for the said computer based test, in which, they were declared successful and thereafter, they were called for document verification, followed by medical examination. All the applicants were declared successful and they were waiting for panel/posting.
Meanwhile, the 4th respondent issued a notice dt. 25.03.2023 to the applicants as well as other successful candidates to produce proof of date of CCCA-NCVT exam, in which they appeared and the date of such exam should be before the closing date of online application i.e. 12.04.2019. It is stated by the applicant that the 4th respondent kept 400 candidates pending after the document verification due to non compliance of various requirements, as prescribed in the employment notification, out of which, 386 candidates are kept pending on account of non compliance of para 12.2 of Centralized notification No. 01/2019.

Whereas, when the candidates answered „yes‟, they were asked only the period of apprenticeship and the name of the zonal railway and there is no specific column indicating the exam appeared. As the applicants completed the apprenticeship as required under Clause 12.2 of the notification, the on-line applications of the candidates were considered and they were allowed to sit for Computer Based Test. The 1 st respondent failed to conduct AITT exam in time for the entire 109 batch and therefore, there was no fault of the applicants in appearing for the All India Trade Test (AITT) examination. Therefore, the applicants requested to consider their cases and provide employment as they have waited for more than 4 years as they were qualified in the selection process at every stage. It is stated by the applicants that pursuant to the representation and various references received in Railway Board office, the 1st respondent, vide letter dt. 01.11.2023, rejected the cases of the applicants, while stating that only those candidates are made eligible who are in line with the policy provision as mentioned in para 11 of Annexure to Board letter dt. 21.06.2016.
5. The contention of the applicants is that their cases are very much in line with the Board letter dt. 21.06.2016. Hence, the impugned letter dt. 01.11.2023 is contrary to the instructions issued by the Railway Board in their letter dt. 21.06.2016 apart from being contrary to Section 22 (1) of the Apprentices Act, 1961 and also contrary to their own conditions in conducting the recruitment of CEN RRC 01/2019. Therefore, the impugned rejection order dt.01.11.2023 is violative of Articles 14, 16 and 21 of the Constitution of India and principles of natural justice.

The respondents 1 to 4 filed reply statement, inter alia, stating that the Ministry of Railway, Railway Recruitment Boards (RRB) have issued Centralized Employment Notification (CEN) No. RRC 01-2019 on 23.02.2019 inviting Online applications from eligible persons for the posts carrying the pay scale of Level -1 in various units of Indian Railways. For South Central Railway Zone, 9328 vacancies were notified in different categories of Level-1. Computer Based Test (CBT) against the said notification was conducted from 17.08.2022 to 11.10.2022 in various phases by RRBs and the results were declared on 22.12.2022, short listing 24596 candidates for PET based on the CBT merit. The Railway Board delegated the process of conducting PET to RRCs, which was conducted from 12.01.2023 to 22.01.2023. The respondents submitted that the para 9.1 of the Notification provides for horizontal reservation for Ex-Servicemen (Ex-SM), Course Completed Act Apprentices trained in Railway Establishments and Persons with Disabilities irrespective of their community. After the CBT, 9636 candidates were shortlisted for document verification and out of 9636 candidates, 991 Course Completed Act Apprentice candidates were shortlisted as per the merit list supplied by RRB, Secunderabad for document verification and medical examination (DV & ME), which was conducted from 07.02.2023 to 13.03.2023.
During the DV, it was noticed that for 386 CCAA candidates have submitted NCVT certificates wherein the month and year of passing is mentioned as April, 2019. The respondents stated that during the document verification conducted for the shortlisted candidates, who qualified in the written examination and PET, it was noticed that the National Apprenticeship Certificate (NAC) submitted by CCAA candidates showed the month of passing as April, 2019, while the NCVT examination for these CCAA candidates was conducted during the period from 20.05.2019 to 14.06.2019, as per the letter of the Deputy Director of Training, dt. 20.05.2019. Date: 2026.03.09 15:47:28+05'30' Foxit PDF Reader Version: 2025.1.0 OA No.020/00672/2023 & Batch candidates should have appeared in the NCVT examination on or before 12.04.2019, which is the last date of registration of online application, whereas, the examination was held from 20.05.2019 to 14.06.2019. In view of the said contradiction in documentary evidence, RRC/SC withheld the results of all such candidates. It is stated by the respondents that out of 991 CCCA candidates called for document verification, 524 candidates, who fulfilled all the eligibility conditions were empanelled and they joined the Railway service.

The respondents stated that a notice dt. 25.03.2023 was published duly mentioning that all the candidates are kept pending and are required to produce the proof of date of CCAA-NCVT exam and after reviewing the proofs submitted by the candidates, 42 CCAA candidates were rejected vide notice dt. 28.04.2023, as they did not appear the said examination on or before 12.04.2019. Upon request by the SC Railway vide its letter dt. 24.04.2023, the Railway Board, vide letter dt. 01.11.2023, clarified that only such candidates who fulfilled all the conditions were made eligible to avail the benefit of provisions and relaxations extended to CCAA candidates and it has not been found feasible to make any change/ relaxation in the notified stipulation. Based on the clarification, the RRC/SC rejected 356 CCAA candidates, who have not fulfilled all the eligibility conditions.
It is the contention of the respondents that the notification clearly stipulates that candidates should ensure that they possess/ fulfill all eligibility conditions as on closing date i.e. 12.04.2019 and it is also stipulated that candidates waiting for final results of prescribed educational qualifications should not apply. However, the applicants knowing well that they have not appeared the NCVT exam before 12.04.2019 and they are not eligible for the post as per the notification, misled the Railway administration by marking "YES" with regard to completed apprenticeship course under the Apprenticeship Act, 1961. It is further stated that if at any stage of recruitment or thereafter, it is found that any information furnished by the candidate in his/ her application is false/incorrect or the candidate has suppressed any relevant information or the candidate does not satisfy the eligibility criteria for the post(s), his/her candidate will be rejected forthwith. The applicants have not only given false information, but also suppressed the correct information while submitting online application and though they had not attended the NCVT examination, they have marked as if they have completed the Apprenticeship. As the All India Trade Test for the applicant had not been completed at the time of submitting their ONLINE application, they were not eligible as per the notification conditions and the eligibility cannot be determined as per the letters issued by the Ministries/ Universities/ Boards. The respondents further stated that the Railways have formulated guidelines for giving employment to the candidates who have completed CCAA from Railways and the said guidelines have been strictly followed during the selection. Further, the Railway Board, vide letter dt. 01.11.2023, advised all the Zonal Railways to follow the instructions in considering the CCAA candidates and it is not feasible to make any change/ relaxation in the conditions already stipulated and therefore, the rules cannot be changed in the middle of the selection process.
8. The respondents stated that course completed means, completion of all the prescribed examinations and having certificates before the cut off date. The applicants have only appeared for CBT and the second stage of selection process i.e. PET was exempted for these candidates. Out of 24596 candidates called for PET, only 14807 candidates were declared qualified and more than 10,000 candidates were eliminated from the selection process even though they have secured more marks in CBT. Further, the applicants have not secured minimum qualifying marks in CBT as per the General candidates. Date: 2026.03.09 15:47:28+05'30' Foxit PDF Reader Version: 2025.1.0 OA No.020/00672/2023 & Batch that the RRC, Mumbai has not appointed any CCAA candidates, who passed in 109th AITT Examination and the letter issued by Ministry of Skill Development and Entrepreneurship, which is filed along with the OA, has not certified that RRC Mumbai has appointed such candidates. The order of this Tribunal in OA No. 210/2013 is based on facts in that OA and the same cannot be applied to the present case. The policy decision/ Selection/ Recruitment related issues have huge ramifications, financial implications and any adverse order implemented would cause a cascading effect on similar cases and also have far reaching consequences as it would result in similar demands from various other categories in Railways. The efforts of the applicants, who are ineligible, to keep the on-going process of selection on hold will curtail the legitimate right of the selected candidates, who are waiting for the appointment to the posts notified. The applicants have approached this Tribunal with unclean hand and have no valid grounds and as such, the OA is liable to be dismissed.
9. Respondent No.5 filed separate reply statement, inter alia, stating that the All India Trade Test (AITT) is conducted by the Directorate General of Training under the aegis of the National Council for Vocational Education and Training (NCVET) for its various schemes. Theory Examinations for Apprentices engaged in Designated Trades under Apprentices Act, 1961 are conducted in Computer Based Test mode by the Directorate General of Training and the practical examines are conducted by the respective establishments, who engage the apprentices. National Apprenticeship Certificate (NAC) are awarded to the successfully passed out candidates of AITT. It is further stated that All India Trade Test (AITT) for apprentices were usually conducted twice a year in the months of April/ May and October/ November till AITT 111. There is no uniform date of start and end of training across establishments throughout the country and the end date of training depends on the duration of course, which differs from course to course and entry qualification of apprentice. It is further stated that the pre-examination activities include registration for examination by apprentice, uploading of marks by establishment, examination centre mapping, Hall Ticket preparation and download, etc. for conducting AITT. The activities of 109th AITT started from 15th March, 2019 as per the schedule dated 14.03.2019, while the cut off date for consideration to appear in examination session April, 2019 was 15.04.2019. The actual examination was held from 29.05.2019 to 14.06.2019, which was decided based on various administrative and logistic aspects. It is further stated by the 5 th respondent that the DGT wrote a letter dt. 07.09.2023 to the Chairman, Railway Board stating that it would be reasonable to consider the apprentices passed in the 109 th AITT examination as qualified as per training completion as on the date mentioned in their respective certificates since date of examination was not under their control. It is also stated that the 5th respondent is a proforma party in the OA
10. The applicants filed rejoinder reiterating contentions made in the OA. The applicants have brought out the details of similar candidates like the applicants, belonging to 109th Batch, who appeared in the notification No. 01/2019 and having course completed before April 2019 and NCVT exam, appeared in the month of May/ June 2019 and were qualified in RRC Exam and were given posting by the other Railways.

The 1st respondent also filed additional reply, pursuant to the direction of this Tribunal, vide order dt. 30.01.2025 as to what decision has been taken by the Railway Board in the matter to avoid discrimination and unrest among the similarly situated candidates. The 1st Respondent Railway Board stated that the Ministry of Railway is involved with policy formulation regarding eligibility criteria for recruitment to various Group C posts. IREC has been made under the provisions of Article 309 of the Constitution and paras 123 & 124 of the said Code stipulate as follows:
Rule 123:- The Railway Board shall have full powers to make rules of general application to Group C & Group D Railway servants under their control. Rule 124:- The General Managers of Indian Railways have full powers to make rules with regard to the Railway servants in Group C & D under their control provided they are not inconsistent with any rules made by the President or the Ministry of Railways.
It is stated that pursuant to the Amendment in Section 22 of Apprentices Act, 1961, Board had constituted a Committee to formulate the policy for according preference to Course Completed Act Apprentices in recruitment. The said Committee had given its recommendations and accordingly, it was decided that 20% of the Level-1 vacancies in case of direct recruitment shall be filled giving preference to CCAAs and instructions to the said effect were issued vide letter dt. 21.06.2016. The 1st respondent also cited para 12.2 of the Notification No. 01/2019 in support of the contention that a candidate shall be considered to have completed the Act Apprenticeship training only if he has appeared in the NCVT examination before the last date for registration of online application i.e. on or before 12.04.2019. The conditions stipulated as mentioned in Board‟s letter dt. 21.06.2016 & para 12.2 still continue to hold good and the same cannot be relaxed when the exam was over long back and changing/ relaxing them would not be justifiable as the candidate, who correctly followed the eligibility conditions and did not apply (being ineligible) will be discriminated while, who wrongly applied will get undue benefit. The respondents have cited the judgment of the Hon‟ble Supreme Court dt. 07.11.2024 in Civil Appeal No. 2634/2023 (Tej Prakash Pathak & Ors. V. Rajasthan High Court & ors) in support of their contention.
12. The respondents filed another Additional affidavit pursuant to the directions of this Tribunal dt. 24.03.2025. In the said additional affidavit, the respondents clarified the status of the candidates in various Railways who have been removed from the list of eligible candidates/ panels or terminated after being appointed by the Zonal Railways. It is stated that ECoR, NFR, NR, SCR, SECR, RDSO have not erroneously empanelled any candidates pursuant to the CEN RRC-01/2019, who have appeared in NCVT Examination after 12.04.2019. Whereas, other Railways viz., CR, ECR, ER, NCR, NER, NWR, SER, SR, SWR, WCR have erroneously empanelled such candidates and have taken steps to delete them from the provisional panel; terminated/ de-empanelled; candidature was cancelled; etc. In WR, show causes were issued to the candidates and some of them have been terminated and the same has been challenged before a Coordinate Bench of this Tribunal. It is further stated that the stipulations given in Board‟s letter dt. 21.06.2016 & para 12.2 still continue to hold good and the same cannot be relaxed at this stage when the exam was long over. The applicants filed MA No. 242/2025 wherein certain material has been filed including the judgment of the Principal Bench of this Tribunal in OA No. 1923 of 2022, dt. 29.07.2022, dismissing the OA with certain directions and the said judgment was upheld by the Hon‟ble High Court of Delhi, vide judgment dt. 17.08.2022 in WP (C) No. 11934/2022.
14. Heard learned counsel for both the sides and perused the pleadings and material available on record. We have also gone through the judgments cited by both the sides.
15. Learned counsel for the applicants argued that the applicants have undergone Course Completed Act Apprentices and were trained in Railway Establishments for one/ two years and they also possess National Apprenticeship Certificate (NAC) granted by the National Council of Vocational Training. They have completed the course and practical test before 12.04.2019 and were found eligible to appear for the posts notified in the Centralized Notification of RRB/RRC No. 1/2019. Learned counsel submitted that the applicants had to appear for the Trade theory exam after 12.04.2019 due to internal delay of the respondent no.5 and the applicants have no control over the same. As the applicants have completed Apprenticeship before 12.04.2019, they were allowed to sit for computer based test (CBT) and having qualified in the said test, they have proceeded for 2nd/ 3rd level of selection process. Learned counsel further argued that the 5th respondent issued schedule of the exams to be held for all those candidates appearing for 109th All India Trade Test (AITT) under Apprenticeship Training Scheme, vide R5 letter dt.14.03.2019 and all the candidates, who participated in the selection pursuant to the notification No.01/2019 have appeared for the exam scheduled as per R5 letter dt. 14.03.2019. It is further submitted that when similar issue was faced by the RRC Mumbai and a clarification was sought, the 5th respondent vide letter dt. 07.09.2023 clarified that those apprentices who passed in the 109 th AITT examination may be considered qualified as per the date of completion of training and based on the said clarification, the RRC Mumbai has recruited all the candidates who applied under CCAAs and appeared for 109th AITT examination irrespective of date of Trade theory exam passed out by them. The contention of the applicants is that they are also similarly situated as that of the candidates before the RRC Mumbai. It is the argument of the counsel for applicants that even in other Railways, similarly placed candidates like the applicants were recruited and they all joined the service.
16. Per contra, learned counsel for the respondents argued that the Ministry of Railway, Railway Recruitment Boards (RRB) have issued Centralized Employment Notification (CEN) No. RRC 01-2019 on 23.02.2019 inviting Online applications from eligible persons for several posts carrying the pay scale of Level
-1 in various units of Indian Railways. Learned counsel submitted that the para 9.1 of the Notification provides for horizontal reservation for Course Completed Act Apprentices trained in Railway Establishments and accordingly, after the CBT, 991 Course Completed Act Apprentice candidates were shortlisted as per the merit list supplied by RRB, Secunderabad for document verification and medical examination (DV & ME), which was conducted from 07.02.2023 to 13.03.2023. It is further submitted that as per para 12.2 of CEN 01/2019 the candidates should have appeared in the NCVT examination on or before 12.04.2019, which is the last date of registration of online application, whereas, the examination was held much thereafter. It is further submitted that the notification categorically mentioned that the candidates should have the required minimum qualifications indicated for the posts as on the closing date for online registration. Learned counsel further submitted that relaxation was given in the case of CCAAs who were trained in the Railway Establishments in those case it was sufficient to have appeared at the NCVT Examination before the last date of registration of online application i.e. 12.04.2019 even if the results were not declared.
17. Learned counsel further argued that on the request of the SC Railway vide its letter dt. 24.04.2023, the Railway Board, vide letter dt. 01.11.2023, clarified that only such candidates who fulfilled all the conditions were made eligible to avail the benefit of provisions and relaxations extended to CCAA candidates and it has not been found feasible to make any change/ relaxation in the notified stipulation.
Based on the clarification, the RRC/SC rejected 356 CCAA candidates, who have not fulfilled all the eligibility conditions. It is submitted that the notification clearly stipulates that candidates should ensure that they possess/ fulfill all eligibility conditions as on closing date i.e. 12.04.2019 and candidates waiting for final results of prescribed educational qualifications should not apply. Despite knowing the fact that they have not appeared the NCVT exam before 12.04.2019 and they are not eligible for the post as per the notification, the applicant misled the Railway administration by marking "YES" with regard to completed apprenticeship course under the Apprenticeship Act, 1961. Date: 2026.03.09 15:47:28+05'30' Foxit PDF Reader Version: 2025.1.0 OA No.020/00672/2023 & Batch information furnished in the ONLINE application and if at any stage of recruitment or thereafter, it is found that any information furnished by the candidate in his/ her application is false/incorrect or the candidate has suppressed any relevant information or the candidate does not satisfy the eligibility criteria for the post(s), his/her candidate will be rejected forthwith. In this case, the applicants have not only given false information, but also suppressed the correct information while submitting online application and though they had not attended the NCVT examination, they have marked as if they have completed the Apprenticeship. As the All India Trade Test for the applicant had not been completed at the time of submitting their ONLINE application, they were not eligible as per the notification conditions and the eligibility cannot be determined as per the letters issued by the Ministries/ Universities/ Boards. The respondents stated that course completed means, completion of all the prescribed examinations and having certificates before the cut off date. The applicants have only appeared for CBT and the second stage of selection process i.e. PET was exempted for these candidates. The policy decision/ Selection/ Recruitment related issues have huge ramifications, financial implications and any adverse order implemented would cause a cascading effect on similar cases and also have far reaching consequences as it would result in similar demands from various other categories in Railways. The efforts of the applicants, who are ineligible, to keep the on-going process of selection on hold will curtail the legitimate right of the selected candidates, who are waiting for the appointment to the posts notified.
18. Having heard both the sides at length and considered the pleadings and the material on record, the question that arises for considerations is whether the action of the respondents in cancelling the candidature of the applicants is sustainable under law.

19. It is to be noted that the Respondents Railways issued Notification No. RRC-01/2019, which was published on 23.02.2029, calling for applications from eligible candidates for various posts carrying the pay level -1 of the pay matrix.
The last date for online registration of applications was 12.04.2019 and the applicants, being CCAAs, responded to the same by submitting their Online applications as required under the notification.
20. To adjudicate the issue involved in the matter, certain IMPORTANT INSTRUCTIONS - ONLINE REGISTRATION & SUBMISSION APPLICATION, given in the said Notifications are referred to hereunder:
"1) Candidates should ensure that they possess / fulfill all eligibility conditions prescribed for the post (s) as on the closing date of online registration i.e. as on 12.04.2019. CANDIDATES WAITING FOR FINAL RESULTS OF PRESCRIBED EDUCATIONAL QUALIFICATION SHOULD NOT APPLY.

7) Eligibility of the candidates will be considered only on the strength of the information furnished in the ONLINE application... If at any stage of recruitment or thereafter, it is found that any information furnished by the candidate in his/ her application is false/ incorrect or the candidate has suppressed any relevant information or the candidate does not satisfy the eligibility criteria for the posts(s), his/ her candidature will be rejected forthwith."
Further, important clauses of General Instructions are as under:
"12.2 The last date for registration of online application i.e. on or before 12.04.2019 of this CEN shall be the cut-off date for completion of Apprenticeship. A candidate shall be considered to have completed the Act Apprenticeship training, only if he has appeared in the NCVT examination before the last date for registration of online application i.e. on or before 12.04.2019 of this CEN and result for which might not have been declared. However, the candidate should submit the NAC certificate issued by NCVT during document verification failing which he/she shall not be eligible for reservation as CCAA (trained in Railway Establishment) under this provision."

Admittedly, the applicants herein did not appear for the NCVT examination before the said cut off.
21. Further, as per the clauses (1) & (7) of the important instructions of the online registration and submission of application, extracted supra, the Candidates should ensure that they possess / fulfill all eligibility conditions prescribed for the post (s) as on the closing date of online registration i.e. as on 12.04.2019 and the CANDIDATES WAITING FOR FINAL RESULTS OF PRESCRIBED EDUCATIONAL QUALIFICATION SHOULD NOT APPLY. Knowing this condition very well, the applicants submitted their online applications and they mentioned in the application as if they have passed the NCVT examination before the cut off date. Therefore, as per the condition of the notification viz., eligibility of the candidates will be considered only on the strength of the information furnished in the ONLINE application, the applicants were considered as provisionally eligible and accordingly, they were called for written test.
22. We have also perused one such online application submitted by one of the applicants and against the column "Have you completed apprenticeship course under Apprenticeship Act, 1961?", it is marked as "Yes". This is totally contrary to the relevant condition in the notification that a candidate shall be considered to have completed the Act Apprenticeship training, only if he has appeared in the NCVT examination before the last date for registration of online application i.e. on or before 12.04.2019 of this CEN. Thus, the applicants have resorted to misrepresentation and suppression of facts. On this ground alone, the applicants can be disentitled from competing for the selection under the subject notification.
23. It is to be noted that in the notification itself, it is clearly stipulated that if at any stage of recruitment or thereafter, if it is found that any information furnished by the candidate in his/ her application is false/ incorrect or the candidate has suppressed any relevant information or the candidate does not satisfy the eligibility criteria for the posts(s), his/ her candidature will be rejected forthwith. Therefore, the respondents are within their powers to cancel the candidature of the applicants as they have given incorrect facts in their applications.
24. The applicants have filed National Apprenticeship Certificates, issued by the Directorate General of Training (DGT) i.e. the 5th respondent, wherein, it is mentioned as if they passed All India Trade Test in the month of April, 2019. But, the fact remains that the Theoretical and Practical exams were not conducted in the month of April 2019. This is very much evident from the Schedule for conduct of 109th AITT issued by the 5th respondent, vide Circular dt. 14.03.2019 (Annexure A-10). The entire text of the said Circular is extracted as under:

The 5th respondent stated in the reply affidavit that as a matter of practice, the apprentices who completed their training on or before 15th April were considered for examination in the April session and the examinations were held in the end of April or the following month(s) depending on various practical aspects and it is make clear that the said examination was held from 29.05.20.19 to 14.06.2019.
25. Therefore, as per clause 12.2 of the conditions of the notifications, the applicants cannot be considered to have completed the Act Apprenticeship training as they have appeared in the NCVT examination in May/ June, 2019 i.e. after the cut off date of 12.04.2019. The applicants knowing fully well that they did not appear for the exam before the cut off date, and thereby, they are ineligible to apply, they misled the Railway administration by marking "YES" against the column regarding completion of Apprenticeship Course. The respondent Railway further stated that there is an anomalous situation that in the certificates produced by the applicants it is shown as if they passed the exam in April, 2019, whereas, the examination was held May/June, 2019 and because of these contradictions also, the RRC/SC withheld the results of all such candidate.
26. It is to be noted that even the Railway Board clarified vide letter dt. 01.11.2023 that only such candidates who fulfilled all the conditions were made eligible to avail the benefit of provisions and relaxations extended to CCAA candidates and it was not found feasible to make any change/ relaxations in the notified stipulations at a later stage. In support of the same, the respondents relied upon judgment of the Hon‟ble Supreme Court in Tej Pramkash Pathak & Ors. V. Date: 2026.03.09 15:47:28+05'30' Foxit PDF Reader Version: 2025.1.0 OA No.020/00672/2023 & Batch laid is that once the recruitment process commences, the State or its instrumentalities cannot tinker with the "Rules of the gage" in so far as the prescription of eligibility criteria is concerned. Therefore, the eligibility criteria prescribed in the notification becomes crucial. As already referred, as per para 12.2 of the notification, the candidates should fulfill the eligibility criteria as on the cut off date, whereas, in the instant case, the applicant acquired such eligibility after cut off date. In the additional reply, the respondent Railways have also given the details of those candidates who have been removed from the list of eligible candidates/ panels and some candidates have been terminated from service after being erroneously appointed, from various Railways.
27. We have also gone through the Order dt. 29.07.2022 in OA No. 1923/2022 of the Principal Bench of this Tribunal, filed by the applicants along with MA 242/2025. In fact, the said OA was dismissed. Challenging the said order, the applicant therein filed WP No. 11934/2022 before the Hon‟ble High Court of Delhi and the Hon‟ble High Court dismissed the said writ petition.
28. Recently, Coordinate Bench of this Tribunal at Mumbai, also dealt with similar issue in OA No. 624/2025 and dismissed the said OA vide order dt. 07.08.2025. Relevant portion of the said order is as follows:
"21. We find that the minimum essential qualification was NCVT as on the cut-off date of 12th April, 2019. The applicant did not possess the said qualification at the cut-off date. Relaxation has been given in terms of clause 12.2 in respect of candidates, who had completed their apprenticeship in the Railways. In their case, they were allowed to participate in the recruitment process provided they had taken the NCVT examination before the last date of registration of online application i.e. 12th April, 2019. Without having participated in the NCVT examination before 12th April, 2019, the candidate was ineligible for recruitment under CEN 01/2019. Therefore, we find that the applicant was not eligible in terms of the notification for recruitment.
22. The question arises as to whether a letter from DGT to consider him as eligible will alter the situation. Again, whether making available a link to upload the marks of NCVT on a later will make the applicant eligible for the current recruitment cycle. Also, whether the argument that the said examination has been done away by the Ministry of Skill Development and Entrepreneurship can make the candidate eligible.

We observe that the office order of Ministry of Skill Development and Entrepreneurship doing away with the examination, on which reliance has been placed by the applicant, is dated 25th January, 2022. It specifically mentions that the order will be effective from 01st January, 2022. This is much after the cut-off date in the notification. It is further mentioned that this order will be applicable retrospectively only to ITI passed candidates, who have cleared practical AITT exam but not cleared the Trade Theory examination. It has not been shown by the applicant that he is covered by the retrospective clause. A Circular/OM which is effective from a later date, in our considered view, cannot grant eligibility for a recruitment process where the cut-off date is before the effective date. Therefore, the order of Ministry of Skill Development and Entrepreneurship dated 25th January, 2022 does not help the cause of the applicant.
24. Providing a link to upload their marks in the NCVT on a later date, we are afraid, does not help the case of the applicant either. The link very clearly was made available to those who had completed their apprenticeship in Railway Establishment on or before 12th April, 2019. The applicant appeared for the test only subsequently but opted for "prior to 12th April, 2019". Merely, opting for the "prior to 12th April, 2019" will not make the candidate eligible when he had not actually done so. The applicant cannot now take the plea that since the link was made available only in 2022, by which time he had passed the exam, he uploaded his marks by opting for "prior to 12th April, 2019" in the link. The respondents had provided the link for only those applicants who were eligible as on 12th April, 2019. Opting for the incorrect option amounts to submitting wrong information. It does not in any way make the candidate eligible in terms of the Notification. Xxx
27. Before we come to this, we need to consider few facts of the applicant. From the said para 3, it is clear that if the employer decides to accept it, he is required to grant concessions for the apprentices appearing and passed in the 109th AITT examination. From the certificate of the applicant (Annexure A3), it is seen that he has passed All India Training Test for apprentices held in September, 2020 and for the 110th AITT. One of two conditions would exist - either the applicant did not appear for the 2019 examination or he failed the 2019 examination - in either case, he is ineligible for the recruitment Notification CEN 01/2019. The letter dated 25th January, 2022 of Ministry of Skill Development and Entrepreneurship recommending acceptance of the date mentioned in the certificate as the date of passing, even if accepted by the respondents, will not help the applicant as his certificate does not show him to have passed the 109th AITT. Therefore, in our considered opinion the applicant does not gain eligibility for the recruitment Notification CE 01/2019 even if concessions are allowed as per the recommendation of DGT.
29. The letter dated 01st November, 2023 of the Railway Board clearly states, in reference to eligibility of CCAAs who appeared in the NCVT examination subsequent to 12th April, 2019, that it is not feasible to make any change/relaxation in the notified stipulations at this stage.
30. We are of the considered view that the recommendations made by the DGT to consider the candidates as per the dates on their certificates requires acceptance by the employer and grant of further concessions with respect to the conditions stipulated in the Recruitment Notification by the employer. It is within the rights of the employer to not accept the recommendations or grant further concessions. The applicant has no right in the matter. It cannot demand concessions as a matter of right. The refusal to grant such concessions, communicated by the Railway Board vide its letter dated 01st November, 2023 to its field offices was, therefore, in order and needs no interference.

31. In view of the above discussions, we decline to quash the show-cause dated 21st July, 2025 and the Railway Board letter dated 01st November, 2023.
Therefore, the reliefs sought cannot be granted. The OA, being devoid of merit, is dismissed. Pending MAs, if any, stand closed. No order as to costs." Even RA No. 14/2025 filed against the said order has been dismissed vide order dt. 03.10.2025.
29. Thus, the issue involved in these OAs has already been dealt with in the Orders referred to above.
30. In view of the above, this Tribunal is of the view that the applicants are not entitled for the relief and the OAs are liable to be dismissed.
31. In the result, the OAs are dismissed, with no order as to costs.
