Mr. Sanjeev Kaushik, appearing for the State, submits that he has received a communication from the Financial Commissioner & Principal Secretary to Govt. of Haryana, Town Country Planning Department, stating that Chairman of the Tribunal has not been appointed, therefore, the appeal filed by the petitioner cannot be taken up for hearing. It is further submitted that till the appeal is taken up for hearing by the Presiding Officer of the Tribunal, respondents will not demolish the structure raised by the petitioner.

Counsel for the petitioner submits that this arrangement may be ordered to continue till interim application in the appeal for stay is decided. Counsel for the petitioner further submits that in view of the statement made by counsel for the State, present petition be disposed of and in case he fails to elicit interim relief in the application filed in appeal, liberty may be granted to him to assail that order. In view of the submissions made by counsel for the parties, present writ petition is disposed of, with liberty aforesaid.
