Petitioner has approached this Court for bail in connection with Nandigram Police Station Case No.993 of 2024. The deceased in this case is one Bishnupada Mondal and the injured in this case is Gurupada Mondal. There is another case registered in respect of the same incident by another relation being Nandigram Police Station Case No.990 of 2024 wherein the same deceased and the injured have been referred to as also the time and place of occurrence is same. It has been contended that the present petitioner has been taken into custody in both the cases being Nandigram Police Station Case No.993 of 2024 and Nandigram Police Station Case No.990 of 2024.
Learned advocate appearing for the State opposes the 2 prayer for bail.
I have taken into account the merits of both the cases. Prima facie, I am of the opinion that Nandigram Police Station Case No.993 of 2024 was subsequently registered pursuant to the information furnished by the wife of the deceased and the other FIR being Nandigram Police Station Case No.990 of 2024 has been registered on the basis of the information furnished by the sister-in- law of the deceased or the wife of the injured.
Prima facie, on an overall assessment I am of the view that the petitioner cannot be arrested in both the cases. Since he has been taken into custody in both the cases as has been informed to this Court and the present case was initiated on a subsequent information, without going into the merits of the case, I am inclined to release the present petitioner on bail.
Accordingly, the prayer for bail of the petitioner is allowed. The petitioner, namely, Uttam Mondal shall be released on bail upon furnishing bond of Rs.20,000/- (Rupees Twenty Thousand only) with two sureties of Rs.10,000/- each, one of whom must be local to the satisfaction of the learned ACJM, Haldia.
If on bail, the petitioner shall once in a week meet with the Officer-in-Charge/Inspector-in-Charge of Nandigram Police Station. Petitioner shall not leave the jurisdiction of Purba Medinipur without prior permission of the learned trial court.
Accordingly, CRM (M) 2291 of 2025 is allowed. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. 3
