                               W. P. 16017 (W) of 2014

                                    Suman Majumder
                                               Vs.
The State of West Bengal & Ors.

                                  Mr. Debashis Basu
                                      ... For the petitioner.

                                   Mr. Dhiraj Trivedi
                                          ... For the State.

The grievance of the petitioner in this writ petition is

that in spite of an application made under Section 6 (3) of

the Right to Information Act, 2005, the authority has not

                        disclosed the information as yet.

At the time of moving the instant writ petition, it is submitted on behalf of

the petitioner that subsequently a letter is issued by the competent authority

requiring the petitioner to deposit the requisite fees to process the said application

under the said Act. It is further submitted that such fees have been deposited

and/or paid but the authority has not provided the information as sought for.

Mr. Trivedi, learned advocate appearing for the State submits that the

information which does not require any fees has already been communicated an/or

              given to the petitioner.

Since the petitioner did not deposit the requisite fees as required under the

said Act, the authority was not obliged to process the said application. As per the

petitioner, the requisite fees have already been deposited and therefore, there is not

impediment on the part of the authority concerned to disclose the information as

sought for under the said Act.

The respondent authorities are directed to furnish the information to the

petitioner for which the fees have been deposited, within two weeks from the date of communication of this order. The time limit indicated hereinabove is peremptory and mandatory.

With this observation, the writ petition is disposed of. No order as to costs. Urgent photostat certified copy of this order, if applied for, be given to the learned advocates for the parties. (Harish Tandon, J.)
