ORAL ORDER
2 18-12-2012Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.
This application has been filed for the grant of regular bail to the petitioners who have been made an accused in a case registered for the offences punishable under Sections 147, 148, 149, 341, 342, 323, 452, 326, 307, 379, 436, 504, 506, 302 of the Indian Penal Code, 17 of CLA Act and 3(X)(XV), 2(III) of SC/ST Act.
In this case instituted against eight named persons besides 30 to 35 unknown. Petitioner's name emerged during investigation in extra judicial confession of one Daroga Choudhary. Submission is of false implication and under similarly situated circumstances good number of co-accused have been enlarged on bail lastly vide order dated 27.08.2012 passed in Cr. Misc. No. 29142/2012, and likewise, nothing has been recovered from the possession of petitioner nor they were ever put on Test Identification Parade, but, they are in custody only because of some criminal cases against them, but, in all such cases they have been released on bail.
If, it is so, let the above named petitioners be Patna High Court Cr.Misc. No.43275 of 2012 (2) dt.18-12-2012 enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand only) each with two sureties of the like amount each to the satisfaction of S.D.J.M., Dehri, Rohtas, in connection with Nauhatta P.S. Case No. 48/2011, with a condition to remain physically present before the court below on each and every date till disposal of the case, in case of failure on two consecutive dates without giving any reasonable explanation, the liberty granted shall be deemed to be cancelled.
