The stand of the respondent-Board in the counter affidavit is that although the petitioner claims to belong to backward class category in which the cut off marks for selection was 80.00 per cent whereas the petitioner had obtained 81.67 per cent but in the OMR sheet (answer sheet) filled up by the petitioner in the course of the written test she had marked "no" against column No. 9 in which the candidate was required to state as to whether he/she belongs to Bihar domicile. For the said reasons, she having herself denied as having Bihar domicile she was treated as falling within unreserved category and thus not selected for participation in the Computer Literacy Test. The said test is a mere qualifying test and marks obtained therein are not added for the purpose of determining the final position of the candidate in the merit list.
Put up among top five cases in the list of zero cases on 25th April, 2011 to enable learned counsel for 2 the petitioner to file a reply to the counter affidavit in which the necessary documents including the application form showing that the petitioner had applied as a B.C. category candidate shall also be brought on the record.
In the meantime, no appointment letter shall be issued to the last candidate among the B.C. category, if the same has not been issued.
Learned counsel for the Board is directed to inform the Court on the next date as to the name, address, etc. of the last candidate.
