DATE :- 8th NOVEMBER, 2023 Pursuant to the order dated 25.10.2023 the learned Additional Government Pleader has tendered a communication dated 01.11.2023 issued by the Department of Water Conservation. It has been stated therein that the request as made in the communication dated 25.08.2023 cannot be accepted since the rivers Irai and Zarpat are not affected by any natural obstructions. On the contrary, there has been discharge of waste material by the Western Coalfields Limited dumped in the said rivers. The said communication dated 01.11.2023 is taken on record and marked 'X' for identification. The learned Additional Government Pleader shall also file an affidavit in terms of the observations in paragraph 3 of the order dated 09.08.2023.
2. The learned counsel for the petitioners seeks leave to implead Western Coalfields Limited as respondent no.9.
3. Leave granted. Necessary amendment be carried out accordingly.
4. After amendment, issue notice to the respondent no.9, returnable on 06.12.2023.
