ORDER

1. The applicants have filed the present Original Application under Section 19 of the Administrative Tribunals Act, 1985 seeking the following reliefs:
a) Hold that the applicants 1 to 14 and 16 are entitled for the actual monetary benefits from the actual date of their placement in the grade of CMO (NFSG) as per orders dated 04.12.2020 (Annexure-A11).
b) Hold that the Applicant No.15 is entitled for the same benefit in terms of the date of placement to CMO (NFSG) grade as per orders dated 04.12.2020 (Annexure-A12).5

c) Direct the respondents to forthwith release the monetary benefits of their DACP promotion to CMO (NFSG) Grade from the dates indicated in Annexure-A11 and A12 respectively, instead of extending the benefits on notional basis as stated in the orders at Annexure A-11 and A-12 respectively.
d) Pass any other orders or directions that this Tribunal may deem fit and necessary in the facts and circumstances of the present case and in the interest of justice.
2. The facts of the case as averred by the applicants in their pleadings, are as follows:
a) Government of Karnataka vide order No:LD 157 LSI 2001 dated 31.03.2003 accorded permission to hand over 500 bedded ESI Hospital, Rajajinagar with the existing inventories of equipment and infrastructure to ESIC New Delhi w.e.f 01.04.2003.
b) Director General ESIC vide orders dated 11.02.2010 issued absorption orders to the applicants herein in ESIC w.e.f 01.01.2006. Aggrieved by the absorption of these applicants w.e.f 1.1.2006, the applicants filed OA. No: 809/2013 to 831/2013 before this Tribunal seeking to settle their grievance relating to the deemed date of absorption. Vide orders dated 16.10.2015, this Tribunal held in favour of the applicants with regard to their claim for deemed absorption w.e.f 1.4.2003 instead of 01.1.2006. The order of the Tribunal was subsequently confirmed by the Hon'ble High Court as well as the Hon'ble Apex Court. 6

c) When the ESIC failed to implement this Tribunal's order in the matter of applicants' absorption in ESIC w.e.f 1.4.2003 instead of 1.1.20006, Contempt Petition No.99-119/2017 was filed before this Tribunal. During the pendency of this CP, however, revised absorption orders came to be issued by the Director General on 29.11.2018 extending the absorption date to 1.4.2003.
d) Government of India vide OM dated 29.10.2008 ordered extension of Dynamic Assured Career Progression (DACP) Scheme up to Senior Administrative Grade (SAG) level in respect of Medical and Dental Doctors in the Central Government.
e) DACP scheme was also extended to SAG level in respect of Central Health Services and Dental Doctors under the Ministry of Health and Family Welfare vide orders dated 29.10.2008.
f) The DACP scheme for ESIC Doctors provides promotion without linkage to vacancies but based on the residency period as given in the scheme.
g) At the time when the Rajajinagar ESI Hospital came to be taken over by ESIC New Delhi from the Karnataka Government in the absorption exercise, a condition was laid down to the effect that Doctors who are joining the ESIC from Karnataka Govt., require to opt either for Institutional seniority or All India seniority. Institutional seniority means remaining in Rajajinagar ESI Hospital till their retirement with the benefits of promotion restricted to the level of Chief Medical 7 OA.No.173/2022/CAT/Bangalore Bench Officer while the Doctors with All India seniority could go up to SAG level under the DACP Scheme.
h) Doctors like the applicants herein opted for institutional seniority.
ESIC insisted in their case that the promotional scope is up to CMO level only under the DACP. This situation led to litigation before this Tribunal in OA. No: 995/2014 which was disposed of on 14.07.2016. This Tribunal held that in the matter of DACP benefits, there cannot be any restriction amongst the class of Doctors working under ESIC on the basis of Institutional seniority or All India seniority.
i) Against the view taken by this Tribunal, ESIC approached Karnataka High Court in WP No.38705/2017 (S-CAT). The Hon'ble High Court by its final orders dated 07.09.2017 modified this Tribunal's order relegating the matter to the Government for taking a decision in the matter on the basis of the DACP Scheme dated 29.10.2008. Karnataka High Court was of the view that, this Tribunal erred in law in considering the claim itself on merits.
j) In response to the directions issued by the Karnataka High Court as above, ESIC on 01.11.2017 passed a speaking order reiterating its stand of DACP benefit up to CMO level only for those Doctors who had opted for Institutional seniority. This speaking order (Ann-A8) became the subject matter of challenge in OA 158/2018 filed on 20.02.2018 before this Tribunal. During the pendency of this OA, certain developments took place at the end of ESIC. In view of the developments, the speaking order Ann-A8 dated 01.11.2017 turned 8 OA.No.173/2022/CAT/Bangalore Bench redundant. Accordingly, OA 158/2018 came to be withdrawn by the said applicant with liberty to work out the other claims, if any, arising out of the promotion of Chief Medical Officer, extended in case of that applicant w.e.f 2.4.2013.
k) In the 174th meeting of the ESI Corporation held on 29.05.2018 at 3.00 PM, it is resolved to extend the benefit of DACP up to the Senior Administrative Grade without any discrimination by placing all the Doctors in all India seniority w.e.f 01.06.2018. A copy of these minutes is placed at Annexure A-10.
l) As can be seen from the minutes of the 174th meeting of the ESIC, which received the approval of the Corporation, ESIC decided to place all the Doctors in All India seniority list w.e.f 1.6.2018. They were to be given notional benefits of DACP from the date of their eligibility with actual monetary benefits only w.e.f 1.6.2018. The Director General issued promotion orders on 04.12.2020 subject to the condition no.3 attached to this order which is based on the resolution of the ESI Corporation in its 174th meeting referred to above.
m) Applicants' grievance in this common application is directed against the decision of the ESIC as reflected in the promotion order dated 4.12.2020 (Annexure A-11) for extending the actual monetary benefits of promotion only w.e.f. 1.6.2018 instead of from the date of their placement in that grade. The legal question that is for consideration is whether or not it is open to the ESIC to restrict the actual monetary benefits only from 1.6.2018 while extending the benefits of DACP 9 OA.No.173/2022/CAT/Bangalore Bench scheme while ordering promotion to the grade of CMO NFSG from the dates as indicated in the order on notional basis especially when the promotions under DACP scheme are without linkage to the actual vacancies of the promotional posts.
n) The challenge in this common OA refers to the orders Ann-A11 and A12 which are dated 04.12.2020. This application is not hit by the limitation question in terms of the provisions contained Administrative Tribunals Act 1985. In this connection, Hon'ble Supreme Court in Misc. Application No.665/2021 in SMW (C) 03/2020 vide corrected order dated 23.09.2021 has made it clear that the period from 15.03.2020 till 02.10.2021 stands excluded in computing the period of limitation, due to COVID situation in the Country.
o) The scheme does not envisage placement in higher scales under DACP on notional basis, whereas the ESIC has chosen to extend the benefit of CMO (NFSG) promotion under Ann-A1l & A12 to the applicants herein on notional basis from the dates indicated under column no.5 of the said orders with actual financial benefits accruing out of such placements only from 01.06.2018 attributing the same to the decision of ESIC in this regard in its 174th meeting referred to above.
p) The applicants requested the ESIC to redress their grievance in this regard by submitting representations individually. However, the authority has failed to redress their common grievance so far.
3. The respondents have filed their written statement wherein they averred as follows:

a) The Office Memorandum issued by the Ministry of Health & Family Welfare CHS Division dated 29.10.2019 clearly states that:-
The above mentioned promotions under DACP Scheme will be made by the Ministry without linkage to vacancies. Other conditions for effecting promotions will be governed by the respective Recruitment Rules as amended from time to time and Department of Personal and Training's instructions in this regard."
b) It is evident from the above that the grant of DACP Scheme is subject to the fulfilment of respective recruitment rules of the concerned organization. The same was upheld by the Hon'ble Apex Court in Civil Appeal No.152/2022 dated 20.01.2022 where the Respondent ESI Corporation was the appellant/applicant.
c) The Terms of Absorption, which had been duly accepted by the Applicants herein at the time of absorption, were as follows:-
"Seniority of an employee absorbed in the Corporation will be determined either from the date from which one holds the post on deputation or from the date one holds the post in equivalent grade on regular basis in the State Government Service, whichever is earlier. Seniority of two or more State Government employees absorbed in the Corporation Service would however be fixed as per the seniority existing in the State Government prior to their absorption. Before absorption an employee will be free to opt for separate institutional seniority i.e., seniority only for particular hospital. In this case, they will not be transferred outside the hospital 11 OA.No.173/2022/CAT/Bangalore Bench even after absorption and the promotions will be based on the institutional seniority only subject to the vacancy in the Hospital OR the individuals can also opt to be part of all India seniority, in which case, they will be liable for all India transfer and promotion avenues. If opting for institutional seniority, the all India posts and cadres to which they will not be eligible for promotion will be the Medical Superintendent of the Hospital and all officers in the pay scale of Rs. 14300-18,300 (current NFSG Scale)"
d) It is evident that, since the Applicants were placed in the Institutional Seniority, their promotional avenues were limited to the extent of CMO. If they opted for, or were placed, under the All India Seniority their promotional avenues expanded upto the level of CMO(NFSG)/SAG/Equivalent cadre. The Applicants, while opting for Institutional Seniority, were well aware that they would be eligible for promotional avenues that upto the level of CMO only and would not be eligible for CMO(NFSG) and above grades.
e) The Applicants have got benefits of grades above CMO after being placed under All India Seniority as per para 3 of the Annexure A-11 and para 4 of the Annexure A10 (Item No.4 of the Minutes of the 174th Meeting ESIC circulated vide letter dated 23.07.2018).
f) The applicants have enjoyed all the benefits of Institutional Seniority (i.e., not having any All India Transfer Liability) and their request to give the monetary benefits while being in Institutional Seniority, after being placed in All India Seniority, will not go side by side. 12

g) The OA No.995/2014 filed by Dr. R .Narasimhamurthy, relied upon by the applicants, was well before the change of the internal policy of the ESI Corporation (i.e., before the implementation of the decisions of the 174th Meeting ESIC). Hence, the applicants cannot claim any kind of benefits by relying upon this judgement.
h) The respondent ESI Corporation intended to grant equal opportunity of promotions up to the level of NFSG and SAG to all the absorbed Medical Officers. Hence, in its 174th Meeting, it approved the placement of all individuals, who were in Institutional Seniority, till that time, under the All India Seniority w.e.f 01.06.2018. As per the approval, they were granted notional benefits to the scale of NFSG under DACP from the date of their eligibility, and actual financial benefits of DACP from 01.06.2018 only, i.e., the date from which they were placed in All India Seniority and became liable to be transferred on an All India basis.
i) The applicants, Medical Officers, who were in service as on 01.06.2018 and placed in All India Seniority, were promoted as per orders of ESI Corporation dated 04.12.2020. The Medical officers were granted notional benefits to the scale of NFSG from the dates they were eligible for promotion and the promoted medical officers were granted financial benefits of DACP only w.e.f 01.06.2018 when they were placed in All India Seniority.
j) Dr. Narasimhamurthy, who filed OA No.158/2018 challenging the speaking order issued by the respondent ESI Corporation, was granted 13 OA.No.173/2022/CAT/Bangalore Bench the promotion to CMO (NFSG) on the basis of the revised policy of ESI Corporation from the date of his eligibility i.e., from 02.04.2013 (Annexure-A11, SI.No.32). On the basis of the same, this Tribunal has disposed of the OA No.158/2018 as infructuous.
k) The decision of the ESIC to restrict the grant of monetary benefits from 01.06.2018 while extending the benefit of the DACP Scheme to the applicants is sustained in the eyes of law. The applicants have enjoyed all the benefits of Institutional Seniority (i.e., barring All India Transfer Liability). Their request for monetary benefits before being placed in All India Seniority, is bad in law.
l) The plea of the Applicants will give more financial burden to the Respondents which is a statutory body established as per provisions of the ESI Act with primary objective to provide social security in the form of certain Cash benefits against loss of wages due to employment injuries and reasonable medical care services to "Workers" class of society. The ESIC is fully financed by the contributions received from workers and their employers. Workers who are deprived class of the society contribute 0.75% of their hard-earned wages to the maximum limit of Rs. 21,000/- per month.
m) There are plethora of judgments issued by various legal forums which is in support of the decisions of the respondents for non-payment of arrears in the event of notional pay fixation.
4. Heard the learned counsels for the parties and perused the pleadings made by them.

In the present case the applicants have sought for grant of actual monetary benefits w.e.f. the date of their promotion to the grade of CMO (NFSG), as against the order of respondents restricting the monetary benefits from 01.6.2018 onwards and indicating that the benefits granted on promotion under DACP scheme shall only be on notional basis prior to 1.6.2018.
6. The applicants have averred that the DACP scheme does not envisage placement in the higher scale on notional basis, whereas the ESIC has chosen to extend the CMO (NFSG) on notional basis from the date of promotion with actual financial benefits accruing after such placement from 1.6.2018 only.
7. The genesis for grant of promotions to the Medical Officers of the ESIC to the level of CMO (NFSG) was the decision taken by the ESIC in its 174th meeting held on 29.5.2018. A perusal of the minutes of this decision indicates the following points:
a) The ESIC had taken over number of ESI Scheme Hospitals from different State Government on 'as is where is' basis. The State Government doctors working therein, at the time of takeover, were absorbed in ESIC. These absorbed employees which included the present applicants were given one time opportunity to opt for Institutional/State or All India Seniority in terms of clause 4 of the standard terms of absorption approved by the ESI Corporation in its 142nd meeting held on 22.2.2008. The actual orders of absorption of these Doctors in ESIC were issued on 11.2.2010 vide office order 37 of 2010 (Annexure A2).15

b) Those absorbed Medical Officers, who opted for Institutional/State seniority, were to be kept posted in hospital only as per their eligibility for promotions upto the level of CMO (Grade Pay 7600 as per 6th CPC). On the other side, those absorbed Medical Officers, who opted for All India Seniority, were liable to be transferred on all India basis but were eligible for promotional posts beyond the level of CMO (i.e. to the grades of NFSG & SAG) against promotional vacancies across the country.
c) There were 184 Medical Officers, who opted for Institutional/State Seniority across all taken-over hospitals. Many of these Medical Officers requested for grant of opportunity to change their option as they lost considerable promotional avenues post implementation of DACP w.e.f. 1/3/2008.
d) ESIC in its meeting held on 29.05.2018, decided to do away with the Institutional/State seniority and decided that each & every absorbed Medical Officer will be placed under All India seniority in order to have equal opportunity of being promoted to the scales of NFSG & SAG. It was further decided that, if any representations are received from any of the absorbed MOs to still place them in institutional/State seniority, the Corporation shall have no objection for their repatriation to their parent organization, if the respective State Government permits so. The employees remaining in the corporation shall be liable for All India Transfer.

e) All these absorbed employees were placed in All India Seniority w.e.f.
1.6.2018. They were granted financial benefits of DACP from 1.6.2018. However, they were also granted notional benefits of DACP from the date of their eligibility.

As can be seen from the minutes of the meeting, and as per the terms of the absorption of the Medical Officers, they were entitled for promotion only up to the level of CMO, if they elected to opt for Institutional/State seniority. They were eligible for promotion beyond the level of CMO i.e. NFSG & SAG only if they opted for All India seniority. This was as per the terms and conditions of absorption offered to them at the time of their absorption under ESIC.
9. This absorption had taken place on 11.2.2010. The DACP scheme which provided for upgradation upto the level of SAG, had been notified on 29.10.2008. Hence, it is apparent that the applicants were fully aware of the DACP scheme as well as the fact that they would not be eligible for upgradation beyond CMO if they opt for Institutional Seniority at the time of their absorption.
10. The DACP scheme envisages promotion without linkage to vacancies.
However, the OM dated 29.10.2008 also states that the other conditions for effecting promotions will be governed by the respective Recruitment Rules, as amended from time to time and Department of Personnel & Training instructions in this regard. It is therefore obvious that grant of DACP is subject to fulfilment of various other service conditions governing promotions. One of the conditions specified in the ESIC was that the 17 OA.No.173/2022/CAT/Bangalore Bench absorbed employees had to opt for All India transfer liability if they were willing to be considered for promotion beyond the level of CMO.
11. There were, therefore, two separate class of absorbed employees created in ESIC, under its terms of absorption. The absorbed employees opting for Institutional seniority, were a separate class, since they had no liability for All India transfer, and they continued to work in the Institution where they were absorbed at that point of time. However, their promotional avenues were restricted up to the level of CMO alone. The 2nd class of employees were those who opted for All India seniority and All India transfer liability with the understanding that, along with this liability, they would also be eligible for consideration for promotion beyond CMO, to the grade of CMO (NFSG) and SAG.
12. Subsequent to the decision taken in the 174th meeting on 29.5.2018, the ESIC decided to do away this distinction and placed all the absorbed Medical Officers in All India seniority in order to grant every absorbed employee equal opportunity of being promoted to the grade of CMO (NFSG) and SAG, under the DACP scheme. It was also decided that in case any of the Medical Officers still wants to be placed under Institutional/State Seniority, they may be allowed to repatriate to their parent organisation if the respective State Government permits so. In other words, all medical Doctors in ESIC, including the absorbed employees, were placed under All India seniority with equal opportunity of promotion to the scales of CMO (NFSG) and SAG under DACP with effect from 1.6.2018. It is consequent to this decision taken by the ESIC that the applicants have been promoted 18 OA.No.173/2022/CAT/Bangalore Bench to CMO (NFSG) under the DACP scheme vide impugned order dated 04.12.2020 (Annexure A-11 & A-12).

Since the distinction between these two classes of employees was abolished w.e.f. 1.6.2018, hence, the actual monetary benefits under DACP were also granted to those employees who had earlier opted to remain in Institutional Seniority, from that date only. All other benefits were granted notionally from the date of grant of notional promotion under DACP to the employees who were under institutional seniority and had not been granted the upgradation beyond CMO grade.
14. The applicants had opted for institutional seniority with the knowledge that without accepting All India Transfer liability, they shall not be eligible for promotion beyond the level of CMO. They become eligible for financial benefits of upgradation beyond the CMO level, only after they were included under the All India Seniority with All India transfer liability. They, therefore became eligible for the actual financial benefits with effect from the date on which they were shifted to All India Seniority with All India transfer liability. It would be discriminatory on the part of ESIC to retrospectively do away with this distinction and grant the benefit to those employees as well who had consciously opted only for Institutional Seniority and opted to forego the benefits of financial upgradation beyond CMO grade in order to avoid All India transfer liability along with such other employees who had opted for All India Seniority along with All India transfer liability and were consequently eligible for opportunity of promotion beyond the level of CMO.

The prayer of the applicants to grant them actual financial benefits from retrospective effect and not from the date when they were incorporated in the All India Seniority list with All India transfer liability cannot be countenanced. The distinction made between these two classes of employees is justified and cannot be considered as arbitrary under any circumstances, since the applicants had themselves made a conscious choice voluntarily at the time of absorption in ESIC. ESIC has now decided to remove this distinction w.e.f. 1.6.2018. It therefore, further decided to grant notional benefits prior to 1.6.2018 under DACP, and full financial benefits subsequent to that date (1.6.2018) to these applicants who were included under All India Seniority list with All India transfer liability with effect from that date.
16. Keeping the above in view, the present OA lacks merit and deserves to be dismissed. Accordingly, the OA is dismissed.
17. However, there shall be no orders so as to costs.
