Heard learned counsel for the parties.

Petitioner is an accused in a case registered for the offences punishable under Sections 14/15/17/18/19/20 of the NDPS Act.

Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case and has not committed any offence as alleged in the F.I.R. It has been alleged that the petitioner and the other co-accused persons were involved in growing poppy plants in their field. The petitioner does not resides in his village as he works as a labourer in West Bengal. The petitioner has no concern with the alleged poppy plants recovered by the police. Co-accused persons namely Manager Murmu and Sudhir Mandal have already been granted bail by a co-ordinate Benches of this Court vide orders dated 20.05.2015 and 28.07.2015 in B.A. Nos. 2371 of 2015 and 4389 of 2015 respectively. The petitioner is in judicial custody since 29.11.2016 and, therefore, his prayer for bail may be considered sympathetically.

Learned A.P.P. has opposed the petitioner's prayer for bail. Considering the aforesaid facts and circumstances, I am inclined to enlarge the petitioner, named above, on bail. Accordingly, the petitioner is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned District & Additional Sessions Judge-I, Jamtara in connection with NDPS Case No.01(B) of 2015, arising out of Nala P.S. Case No.43 of 2015.
