Heard on the question of admission.
2.Issue notice to the respondents on payment of process fee by RAD as well as ordinary mode within seven working days. Notice be made returnable within four weeks.
3.Also heard on the question of interim relief.
4.Learned counsel for the petitioner has drawn attention of this Court to the order dated 28.7.2021 passed in W.P.No.13428/2021 whereby by a coordinate bench of this Court had stayed the effect and operation of the order 20.7.2021 (Annexure P/2) by which the petitioner has been transferred from Sheopur to Gwalior. Learned Counsel for the petitioner further submits that the petition is still pending and now again the respondents have issued the impugned transfer order dated 28.02.2022, by which the petitioner has again transferred from Gwalior to Sheopur.
6.From the said order it appears that just to dilute the effect of the earlier stay order, this fresh transfer order has been issued.
7.Learned Govt. Advocate contended that the impugned transfer order is passed on administrative grounds, and therefore, it should not be interfered.
8.Considering the facts and circumstances of the case, the effect and operation of the impugned order dated 28.2.2022 (Annexure P/1) so far as it relates to the petitioner is concerned shall remain stayed till the next date of hearing.
9.List the matter in the week commencing 2nd May, 2022 along with W.P.No.13428/2021.
