FACTS:-
By his letter of 22/02/2007, the complainant had requested for information from PIO, FCI, District Office Faridkot, on the following two points:-
"(i) Certified copy of the Statement showing stocks of FCI rice Raw deposited in State Warehouse, Nihalsinghwala pertaining to crop year 2000-2001, 2001-2002, and 2002-2003 by the FCI along with a certificate that stocks so deposited were taken back by FCI and no claim of shortage was lodged with PSWC.
(ii) Certified copies of Warehouse Receipts for deposit of rice 2003-04 in State Warehouse Nihal singhwala by FCI against which recovery of cost of 16,019 bags rice has been made from the PSWC on account of non delivery of these stocks."
2. By subsequent letter dated 14/03/2007, the complainant had requested for additional information on the following points:-
"I. Certified copy Gunnies statement for the period 2K-01,01-02,02-03,03-04 of made up gunnies in respect of rice dispatched to exN.S.Wala to various specials/rice dispatched w.e.f. June, 200 to OPct., 2004. Month- wise/cropwise detail.
II. Certified copy of statement of issue of gunnies against made up bags in rice w.e.f Jun, 2000 to October, 2004 to PSWC N.S.Wala alongwith Acknowledgements by PSWC N.S. Wala.
III. Copy of Stock Balance in PSWC as on 31/3/04 of old as stockwise/Godownwise.
IV. Copy of Priority given by Technical Section for issue of stocks of RRA during the month of 3/04,404&5/04.
V. Copy of Enquiry report conducted by SRM FCI Pb Chandigarh's against Shri Harcharan singh A.M.(D), Sh. Piara Singh A.G.3 against the charges of recording the entry of Rice stored at S/W N.S. Wala while the consignments lwere not physically stored at N.S. Wala. VI. Copy of joining report of the above said officials at S.No.V at FCI FSD N.S. Wala."260HariKrishanFCIPb25 02 2 2
3. The PIO had responded to him vide his letter dated 20/12/2007 enclosing therewith copies of certain documents. The said letter is reproduced below:-
"Kindly refer to R.O. (Punjab) Chandigarh letter No. D/25/(17)/GUNNY/MISC 2007-08/3519 dated 12.10.2007 received from Area Manager, FCI Faridkot at District Office Moga. The information required from Manager (D) FCI FSDNS wala duly attested are enclosed herewith as per detail given below :-
1. Certificate required by the applicant (annexure-A)
2. Rice receipt from PSWC pertains to PSWC authority
3. GUNNY statement 4/2001 to 3/2004. 8/2001 to 9/2001 not available.
4. Point No. 1 information not available at FSD.
5. Monthly stock account for the month 31.03.2004 (Annexure-C)
6. A priority of 12.06.2004 to 5/2004 not available in the file.
7. Inquiry report of against Harcharan Singh (D) and others not available at the Centre.
8. Joining report of official not available at this office.
This is submitted to you for information please."
4. Dissatisfied with the information provided to him, the complainant has filed the present complaint before the Commission.
5. The matter was heard on 25/02/2009. The complainant appeared before the Commission. However, none appeared on behalf of the FCI which is viewed adversely by the Commission.
6. The complainant informs that the name of PIO is T.N. Goyal and that of the Appellate Authority is Shri D.K. Yadav. Summons may be issued to Shri T.N. Goyel, (PIO), Food Corporation of India, District Office, FCI Road, Moga(Pb.) and Shri D.K. Yadav, Food Corporation of India, District Office, FCI Road, Moga(Pb.), (Appellate Authority), for appearance on 30.3.2009 at 1130 hrs before the Commission. They are also directed to submit their written representation, if any two days before the aforesaid date of hearing with a copy there of to the complainant.
