Section 374 in The City of Panaji Corporation Act, 2002

374. Power of State Government to require municipal authority to take action.

- If the Commissioner fails within such period as may have been fixed by the State Government to furnish a document called for under section 372, or if on receipt of any document furnished under section 372 or of any report submitted under section 373, or of any information which appears to the State Government to require action under this section, the State Government is of opinion that-
(a)any of the duties imposed by or under this Act or by any other law for the time being in force has not been performed or has been performed in an imperfect, inefficient or unsuitable manner; or
(b)the Corporation, the Standing Committee, the Commissioner or any other officer or servant of the Corporation has failed to take such measures in any matter as appear to the State Government to be required by the circumstances of the case; or
(c)adequate financial provision has not yet been made for the performance of any such duty or the taking of any such measure; the State Government may, by written order direct the Corporation, the Standing Committee, the Commissioner, or any other officer or servant of the Corporation within a period specified in the order-
(i)to make arrangements to the satisfaction of the State Government for the proper performance of the duties referred to in clause (a) or to take such measures as may be specified by the State Government in connection with any matter referred to in clause (b), or to make financial provision to the satisfaction of the State Government for the performance of any such duty or for the taking of any such measure, as the case may be, or
(ii)to show cause to the satisfaction of the State Government against the making of such arrangements, the taking of such measures or the making of such provisions, as the case may be.
