Petitioner's only grievance is that the Registrar of Madhya Pradesh Medical Council Bhopal has refused to register Additional Qualification of the petitioner i.e. Diploma in Pathology & Bacteriology obtained by her from the college of Physician & Surgeons, Mumbai on the ground that unless and until M.P. Medical Council Act is amended such qualification cannot be registered.

Counsel for the petitioner has drawn attention of this Court to order dated 16.08.2016 passed by State of Madhya Pradesh Public Health and Public Welfare Department wherein it is mentioned that recognition is granted to CPS Courses by making necessary amendment in the Madhya Pradesh Medical Council Act.

In view of such order, counsel for the petitioner submits that the impugned order Annexure P-1 is illegal and arbitrary and has been passed without taking into consideration the fact that the State of Madhya Pradesh has already amended the Madhya Pradesh Medical Council Act and has given recognition to CPS Courses.

In view of such submission which are not disputed by the learned panel lawyer, this petition is disposed of with a direction to respondent No.3 to take into consideration the amendment in Madhya Pradesh Council Act as is mentioned in the order dated 16.08.2016 and consider the case for registration of additional qualification of the petitioner obtained from CPS Mumbai within a period of three months from the date of receipt of certified copy of the order passed today.

With the aforesaid direction, this petition is disposed of.
