This order shall dispose of the present petition filed under Section 439 Cr.P.C seeking concession of regular bail to the petitioner pending trial in case FIR No.93 dated 22.09.2014 under Sections 420/467/468/409/201/120-B IPC, registered at Police Station Bhikhi, District Mansa.
Counsel for the parties have been heard.
FIR in question was registered on the complaint of Vinod Kumar, District Manager, Markfed, Mansa with regard to embezzlement of grain stock at Markfed Branch Bhikhi and a short fall of 15546 bags having been found upon physical verification.
The present petitioner is stated to be serving as a Salesman of a retailed outlet at Bhikhi. It has been contended on behalf of the petitioner that he was never the Branch Incharge and as such, was not HARJEET KAUR 2015.07.17 02:47 I attest to the accuracy and authenticity of this document CRM No.M-22414 of 2015 (O&M) -2- responsible as regards the grain stock. Counsel further argues that the responsibility, if any, regarding short fall of grain stock had to be affixed upon the Branch Manager and the present petitioner, who is a mere Salesman is being made a scapegoat.
Petitioner has been in custody since 09.02.2015. Learned State counsel upon instructions from ASI Shivjit Singh has apprised the Court that investigation in the present case having been completed, challan was presented on 19.12.2014.
The trial is still at the initial stage and would take time to conclude.
Without making any observations on merits, the petitioner is held entitled to the benefit of regular bail.
Accordingly, petition is allowed. Petitioner, Bhola Singh be enlarged on bail subject to the satisfaction of CJM/Duty Magistrate Mansa.
Disposed of.
