38. Power to fine chaukidars. - Every chaukidar who may be guilty of any wilful misconduct in his office, or neglect of his duty, such misconduct or neglect not being an offence within the meaning of the Indian Penal Code (XLV of 1860) and not being of so grave a character as in the opinion of the [District Magistrate] to require his dismissal from his office, shall be liable to a fine which shall not exceed the amount of one month's salary.
