Heard learned counsel for the petitioner and learned Standing Counsel for the respondents.
This writ petition has been filed seeking a direction in the nature of mandamus commanding the respondents to revise/fix the pension after giving the benefit of next pay upgradation under the Assured Career Progression Scheme (ACPS) after completion of 26 years of service and also by including the period spent during the training in view of the G.Os. dated 26.8.2015, 3.3.2015, 5.11.2014, 17.3.2012 and 21.7.2011. In respect of his claim, the petitioner is stated to have preferred representations on 13.5.2019 and 3.8.2019, copies of which have been filed as Annexure-4 to the writ petition, but it is stated that no order has been passed thereon.
No useful purpose would be served in keeping the petition pending.
This writ petition is therefore disposed of with the consent of learned counsel for the parties with a direction to the respondent no.3- Senior Superintendent of Police, District Bulandshahar to decide the pending representations dated 13.5.2019 and 3.8.2019, in accordance with law, within a period of three months from the date a certified copy of this order is received in his office.
The petitioner shall also provide a copy of the writ petition along with certified copy of this order to respondent no.3.
It is made clear that the Court has not adjudicated the claim of the petitioner on merits.
