We have heard learned counsel for the parties and perused the record.

Mr. Vikramjit Banerjee, learned senior counsel for respondents No.2 to 5, has stated that summary suit has been filed by the appellant for recovery of the amount involved in the cheques in question. We record his submission.

In view of above, since the appellant has remedy to recover the amount, we do not find any ground to interfere with the impugned order.

The appeal is accordingly dismissed.
