O R D E R
By Honble Mrs. Rajwant Sandhu, Member(A):-
1. The present O.A. has been filed by the applicants seeking a direction to the respondents to release their over-time allowance.
2. In support of his claim, learned counsel for the applicants submits that the applicants have preferred joint representation (Annexure A-3) to the respondents for release of over-time allowance but nothing has been communicated to the applicants till date. He makes a statement at the Bar that the applicants would be satisfied if the OA is disposed of with a direction to the respondents to consider and take a view on their representations in accordance with law, within a reasonable period, as directed by this Court in O.A. (NO. 061/00011/2015) filed by the similarly situated employees decided on 12.02.2015.
3. In view of the limited prayer of the applicants, there is no need to issue notice to the respondents and call for their reply. Moreover, non issuance of notice would not cause any prejudice to the respondents as they have not yet replied to the representations filed by the applicants, which they are supposed to do within a period of six months as per Section 20 of the Administrative Tribunals Act.
4. Accordingly, the O.A. is disposed of with a direction to the respondents to consider the representations (Annexure A-3) filed by the applicants and take a view thereon in accordance with law, within a period of one month from the date of receipt of a copy of the order.
5. Needless to say that we have not expressed any opinion on the merits of the case. No costs.
