The Original Applications (OA Nos.305/2022, 3/2024, 72/2024 &211/2024
having been heard on 31.10.2025, 03.11.2025, 04.11.2025, 06.11.2025,
07.11.2025, 10.11.2025 & 13.11.2025, the Tribunal on 24/11/2025 delivered the
following:
ORDER
Per: Mr. Braj Mohan Agrawal, Administrative Member These OAs are taken up together being connected. 1(a) OA No.305/2022: The applicants are group of employees who were absorbed on 28.12.2015 and denied ante-dating their date of absorption with effect from 17.08.2012 vide Annexure-A18. Aggrieved by impugned order Annexure-A18 and Annexure-A16, they filed the Original Application praying for the following reliefs:-
(i) To call for records leading to Annexure-A16, A18 and quash the same to the extend it refuses the benefit of absorption with effect from 17.08.2012 to the applicant
(ii) To direct the respondents to treat the applicant as absorbed with effect from 17.08.2012 with all consequential benefits including arrears of pay and allowances with interest at 2025.11.26 V R ARUNKUMAR 10:41:49 +05'30' 31 O.A Nos. 180/00305/2022, 3/2024, 72/2024 & 211/2024 the rate of 12% per annum
(iii) To direct the respondents to fix the pay of the applicant under FR 22(I) (a) (1) on their absorption to the cadre of unskilled labourer {MTS(industrial)} with all consequential benefits including arrears of pay and allowances with interest @12% per annum 1(b). OA No.03/2024: Applicants are direct recruits who were recruited on 15.09.2015, 16.09.2015, 17.09.2015 and 18.09.2015. They submit that party respondent Nos. 5 to 41 were appointed on 28.12.2015 wihout any court orders and their names were not in the seniority list of 2015 (Annexure A-6). Now the seniority list is revised suo-motu (Annexures A12 and A13). In the revised seniority list the direct recruited applicants are lowered in seniority and placed at Sl.No.555 to 725 and party respondents 5 to 41 are placed before the applicants from Sl.No.397 onwards. The applicants were brought down by impugned orders Annexure A-11, A-12 and A-13 from the earlier allotted seniority of 2015 and placed below the absorbed TDMs who were arrayed as respondents No.5 to 41 and who were recruited later than the applicants. The respondents are fence sitters and prevented to alter seniority list on sit back theory.
Aggrieved by the alteration in their position in the seniority list after 8 years on 26.09.2023 vide letter Annexure-A11 and Seniority List Annexure-A12, 2025.11.26 V R ARUNKUMAR 10:41:49 +05'30' 32 O.A Nos. 180/00305/2022, 3/2024, 72/2024 & 211/2024 A-13 sought the following reliefs:-
(a) Call for the records connected with the case and declare Annexure-A11 memorandum and revised seniority lists Annexure-
A12 and Annexure-A13 are illegal and not sustainable in the eye of law and quash the same
(b) Direct the respondents to maintain the Annexure A-6, A-7 and A-8 seniority list and consider the applicants for promotion on further posts with consequential benefits
(c) Declare that the applicants are entitled for seniority immediately after the absorbed employees on 14.09.2015 and direct the 2nd respondent to provisionally promote the applicants in the available promotion vacancies based on Annexure-A8. 1(c). OA No.72/2024: The applicants herein are the direct recruits selected in the year 2015 in the post of Tradesman Mate (TDM), working under the Southern Naval Command. Applicants have submitted that initially, the selection to the post by way of direct recruitment was challenged by the workers, who were claiming for absorption to the post, but the same was finally decided in Annexure- A5 judgement of the Hon'ble High Court of Kerala. After absorbing the petitioners in Annexure-A-5, who were eligible, the rest of the vacancies were earmarked for direct recruitment and thus the applicants were appointed as per Annexures-A1 to A-4 orders.
Annexure-A-6 to A-8 seniority lists were published and are in force. On the 2025.11.26 V R ARUNKUMAR 10:41:49 +05'30' 33 O.A Nos. 180/00305/2022, 3/2024, 72/2024 & 211/2024 basis of the said seniority list, applicants herein were promoted to different posts, as per Annexure A-9 to A23 orders, years back. There was no challenge against these seniority lists or promotion orders so far. However, referring to Annexure A24 final order of this Tribunal in OA 835/2016 the 4 th respondent Steering Committee has decided to implement and enforce the said order with respect to all the absorbed workers, those who were absorbed into regular service, even after the appointment of the applicant.
Rejecting applicants objections to the proposed revision in seniority list, 2 nd and 7th respondents (official ones) issued Annexure A31, A-32 and A-33 proceedings in which it was communicated that the party respondents (workers who were absorbed on 28.12.2015) herein will be placed above the applicant herein, following the Annexure-A5 judgement (Hon'ble High Court Kerala judgement in OP(CAT) No.37 of 2014 and Annexure-A24 Final order, where-under, it was categorically made clear that the directions are applicable to the applicants/petitioners therein only. Even the absorption of the party respondents R-10 to R46 are illegal and in contravention of directions of Annexure-A5 judgement.
Aggrieved by the above, the following reliefs have been sought:-
(i) To call for the records in connection with decision no.5(z) of the Steering Committee Meeting of JCM IV Level 2025.11.26 V R ARUNKUMAR 10:41:49 +05'30' 34 O.A Nos. 180/00305/2022, 3/2024, 72/2024 & 211/2024 Council held on 17.08.2023 issued vide Annexure A-27 communication No.CS 1311/4/ dated 25.08.2023 and the proceedings in Annexure-A26 Memorandum No.CS 2764/1/70 dated 25.09.2023, Revised Seniority List as on 31.12.2015, published in Annexure-A28, Revised Seniority List as on 31.12.2016 published in Annexure-A29, Annexure A31 Memorandum No.CS 2764/1/70 dated 16.01.2024, Annexure-A32 Order No.274/6/02 dated 31.01.2024 and Annexure-A33 Order No.PA/03/2770/07 dated 31.01.2024 issued by the respondents no.2 to 9 and to set aside Annexure-A26, A-27, A-28, A-29, A-31, A-32 and A-33 declaring that the seniority finalized as per Annexure-A6, A-7 and A-8 cannot be revised and altered by lowering the seniority of the applicant herein.
(ii) To declare that the decision No.5(z) of the Steering Committee Meeting of JCM IV Level Council held on 17.08.2023 issued vide Annexure-A27 communication No.CS1311/4 dated 25.08.2023 cannot be enforced or implemented and the respondents no.10 to 46 are not entitled to claim any parity with or benefit given to the petitioners or applicants in Annexure-A5 judgement and Annexure-A24 final order
(iii) To declare that the respondents No.10 to 46 are not entitled to claim any seniority over and above the applicants herein and the respondents 2 to 9 cannot amend or revise the promotions effected and granted as per Annexure A-9 to A23 orders and the existing seniority granted to the applicants herein on implementing Annexure-A9 to A23 orders.
(iv) To direct the respondents 2 to 7 that the applicants herein shall not be reverted from the post to which they have promoted as per Annexure-A9 to A-23 orders, disturbing their seniority granted in Annexure A6 to A8 orders 2025.11.26 V R ARUNKUMAR 10:41:49 +05'30' 35 O.A Nos. 180/00305/2022, 3/2024, 72/2024 & 211/2024 1(d). OA No.211/2024: Applicants were absorbed as Trades Man Mate on 14.09.2015. The 1st applicant submits that overlooking their legitimate claims, junior to the applicants namely M.V. Vishnu (respondent No.28) has been promoted as Mech.(AE) SK w.e.f. 03.04.2023. Attempts are being made by the Department promoting his juniors to the post of Mech(AE) by revising the settled seniority with retrospective effect affronting the principle of 'sit back'.
The 2nd applicant was absorbed with effect from 14.09.2015 and claims to be eligible to be considered for promotion to the post of Tailor(SK) with effect from 2016. Junior to the applicant Shri Vishnu M.V. has already been promoted as Mech.(AE) SK with effect from 03.04.2023.
Party Respondents 5 to 27 (workers who were absorbed on 28.12.2015) and others seeking seniority with retrospective effect above the applicants and similarly placed candidates was rejected by the department on 19.04.2023 (Annexure A-6). Thereafter, by Annexure-A7 proceedings dated 25.09.2023 the settled seniority has been revised with retrospective effect from 2015 onwards. The applicants and similarly placed incumbents and directly recruited Trades Man Mate have been superseded. The representations submitted by the applicants and other aggrieved persons have been rejected by Annexure-A11, A12 and A13 proceedings.
2025.11.26 V R ARUNKUMAR 10:41:49 +05'30' 36 O.A Nos. 180/00305/2022, 3/2024, 72/2024 & 211/2024 The applicants have further submitted that they were absorbed against the substantive cadre of Trades Man Mate w.e.f. 14.09.2015. They have been continuously officiating in the substantive vacancies from 14.09.2015 onwards. The post of Trades Man Mate remained unfilled as on 14.09.2015 and the applicants were absorbed against the same vacancies. The applicants carry seniority in the cadre w.e.f. 14.09.2015. The party respondents 5 to 27 had been officiating the post of Trades Man Mate only w.e.f. 28.12.2015. By the impugned seniority lists, the applicants are superseded without notice, affecting their fundamental right under Article 14 and 16(a) of the Constitution of India.
Aggrieved by above, the applicants have filed the original application and sought the following reliefs:-

(b) To call for the records leading to Annexure A14 proceeding dated 31.03.2023 and Annexure-A15 order dated 2025.11.26 V R ARUNKUMAR 10:41:49 +05'30' 37 O.A Nos. 180/00305/2022, 3/2024, 72/2024 & 211/2024 10.04.2023 and set aside the same in so far as it promotes respondent No.28 Shri Vishnu M.V as Trades Man Skilled Mech.(AE) S.K.
(c) To declare that the respondents No.5 to 28 are not entitled to claim seniority over and above the applicants herein and the official respondents cannot amend or revise the settled seniority of Tradesman Mate by Annexure A-7, A-8 and A-9 and such other orders.
(d)To direct the respondents 2 to 4 to maintain the Annexure-A2 and such other seniority list of Tradesman Mate prevalent before 25.09.2023 and to consider the claim of the applicants for promotion to the cadre of Tradesman Skilled Mech(AE) S.K. on due date with all consequential benefits
(e)To direct the 2nd respondent to provisionally promote the applicants in the available promotion vacancies, namely Mech(AE)-Trades Man (Skilled) forthwith with all consequential benefits
(f)To declare that the applicants are seniors to respondent No.5 to 28 in the cadre of Trades Man Mate and that the supersession of the applicants by the respondents No.5 to 28 in the matter of seniority in the cadre of Trades Man Mate is illegal, violative of Article 14 and 16(1) of the Constitution of India and may be set aside.

Annexure-A4 OA The method of Recruitment to the category of 305/2022 MTS(Industrial) [erstwhile Unskilled Labourers etc.] is now only Direct Recruitment.
05 Order of Absorption issued in case of 56 persons, who 17.08.2012 had completed 5 years of service, but those with VIII Annexure-A5 OA Std pass qualification for DR under 2000 Rules, eligible 305/2022 for absorption is not considered at all.
06 Corrigendum issued on notification dated 1.6.2012, 16.11.2012 increasing vacancies of unskilled labourers as 235 Annexure-A6 - OA 305/2022 07 OA 1179/2012 filed by SNCCEA (employees 19.2.2014 Association), and connected cases, claiming that the Annexure-A7 OA vacancies reflected in the DR notification ought to be 305/2022 filled by absorption and DR can be resorted only if the same fails is dismissed.
2025.11.26 V R ARUNKUMAR 10:41:49 +05'30' 39 O.A Nos. 180/00305/2022, 3/2024, 72/2024 & 211/2024 08 OP (CAT) 37/2014 filed against final order in OA 21.2.2014 1179/2012 was admitted and A3 and A7 therein, ie. Annexure A8 notification of 1.6.2012, and corrigendum of OA 305/2022 16.11.2012, were stayed by interim order. 09 An order is issued on the same day as the interim order 21.2.2014 of the Honourable High Court making DR to the Annexure A9 vacancies. OA 305/2022 10 OP (CAT) 37/2014 and connected cases are allowed. 8.7.2014 The Honourable Court found that the DRs can be made Annexure-A10 only after the absorption. 3. Relevant extracts of order of Hon'ble Supreme Court, Hon'ble High Court of 2025.11.26 V R ARUNKUMAR 10:41:49 +05'30' 43 O.A Nos. 180/00305/2022, 3/2024, 72/2024 & 211/2024 Kerala and this Tribunal in connected cases are reproduced below. The Hon'ble High Court of Kerala in OP(CAT) No.37 of 2014(Z) dated 08.07.2014 observed the following:
A. "In the result, these original petitions have to succeed. We allow the same by holding as follows:-
*Annexure A2 Rules, in their application to the post of unskilled Labourer, must be seen as including within the ambit of the feeder category, three categories of persons namely, (I) Group D employees of the Navy with at least five years regular service in the pay scale of Rs.2550-55-2660-6-3200. (ii) Persons serving in analogous equivalent or higher grades in the lower formations of the Defence Service with at least five years regular service in the pay scale of Rs.2550-55-2260-60-3200 and (iii) Persons possessing the qualification and experience as laid down in column 8 for direct recruitment viz. A pass in the 8 th standard from a recognized Board/Institution. *In its application to Group D employees of the Navy seeking absorption to the post of Unskilled Labourer, Annexure A2 Rules must be seen as conferring two avenues of promotion, by absorption to such empolyees depending upon whether or not they possess the qualification of a pass in 8 th standard from a recognized Board/Institution, the qualification laid down for direct recruitment.
*The Naval establishment cannot rely on the classification change, brought about in 2006 in respect of Group D employees, to deny the rightful claim of the petitioners for consideration to the post of Unskilled Labourer in terms of Annexure A2 rules. *The mere fact that the petitioners had not challenged Annexure-R1 memorandum cannot be a reason to non suit them in a legitimate pursuit of their rights or to deny them the benefit of the Rules.
*In the case of those members of the petitioner Union who chose to abandon their claim for absorption as unskilled labourer, by choosing to participate in the selection process envisaged for direct recruitment under Ext.P1 notification and 2025.11.26 V R ARUNKUMAR 10:41:49 +05'30' 44 O.A Nos. 180/00305/2022, 3/2024, 72/2024 & 211/2024 failed in the same, they cannot resurrect their claim for absorption as per Annexure-A2 Rules. The said persons, we feel, have forfieted their right to claim absorption as per Annexure-A- 2 Rules.
*We set aside the impugned order of the Central Administrative Tribunal and allow the OA by quashing Annexure-A3 and A7 to the extent they contemplate the filling up of vacancies that arose prior to 9.6.2012 in the category of unskilled labourers by resort to direct recruitment. We further direct the Naval establishment to consider the candidature of those among the petitioners who stand qualified as per this judgment to the said vacancies.
*We make it clear that after providing for such of the petitioners as indicated above, the Naval establishment will be free to fill up the remaining vacancies by way of direct recruitment pursuant to Annexure-A3 and A7 notifications."
B. The relevant paragraphs of the order of this Tribunal in OA No.725/2015 dated 07.01.2016 are reproduced below:-
"4. In the light of the above statement expressly made in the pleadings of the respondents, we feel that the OA can be disposed of with a direction to the respondents to expedite the process of consideration of the applications submitted by the applicants for absorption as unskilled labourers as per Annexure- A1 Recruitment Rules and in terms of the judgment of the High Court in OP(CAT) No.37 of 2014 and other connected cases.
5. Accordingly the respondents are directed to consider and dispose of the applicants' request within two months from the date of receipt of a copy of this order. If the applicants are selected in the process of absorption, their respective seniority shall be considered in accordance with the extant rules. Applicants are granted liberty to approach this Tribunal, if any further grievance is left un-redressed relating to the selection process."
2025.11.26 V R ARUNKUMAR 10:41:49 +05'30' 45 O.A Nos. 180/00305/2022, 3/2024, 72/2024 & 211/2024 C. The order of this Tribunal in OA No.835/2016 dated 21.12.2021, paragraph 18 is as follows:-
"In light of the above conclusions/findings, we quash Annexure A- 12 to the extent that it allows the benefit of absorption to the applicants to the post of Unskilled Labourers/MTS (Industrial) only with effect from 14.09.2015. The applicants are entitled to be considered for absorption with effect from 17.08.2012. As regards any benefits like payments of pay arrears and allowances with interest, we do not find that the applicants are entitled to the same. They are only entitled to get a notional pay fixation and seniority to be taken, on their absorption to the post of Unskilled Labourers/MTS (Industrial) with effect from 17.08.2012, as per the concerned rules/ orders in this regard. As regards fixation of pay under FR 22(I)(a)(1), we would only limit our directions to the effect that the respondents may be guided and take necessary steps on the same basis as they had done for the 56 senior employees, who were absorbed to the post of Unskilled Labourer/MTS (Industrial) with effect from 17.08.2012. However, as stated, it would not be correct for the applicants to get benefits like arrears/interest from the concerned date ie., on 17.08.2012, as they did not function as MTS (Industrial) from that day. They may thus only be given the benefit of a notional fixation along with other consequential benefits of seniority and future promotion in terms of their service rules, etc. We dispose the O.A with these directions. There shall be no order as to costs."
D. SLP 35668-35669/2014 is filed by the candidates who had actually appeared for the exam and hence held ineligible by the High Court. SLP(C) 5197/2014 is filed by a candidate who came through Direct Recruitment. SLP 5197/2014 was disposed of by Hon'ble Supreme Court on 28.09.2015 noting that the 'concerned persons' are given appointment and hence SLP is infructous. SLP 2025.11.26 V R ARUNKUMAR 10:41:49 +05'30' 46 O.A Nos. 180/00305/2022, 3/2024, 72/2024 & 211/2024 35667/2014 and connected cases were dismissed by Hon'ble Supreme Court on 05.10.2015.
4. The arguments of the learned counsel for the applicant in OA No.305/2022 rests on the claim that appointment of the applicants is made to vacancies prior to Annexure-A4. The said appointment was due even before the promulgation of Annexure A-4, and even before Annexure-A3 was issued. This aspect has been accepted by the Hon'ble High Court of Kerala. The applicants are appointed to such vacancies. The said vacancies were sought to be filled by Annexure-A2, resulting in Annexure-A6. Atleast similar treatment ought to have been given to the applicants also. The applicants are entitled to and eligible to be absorbed in vacancies in existence on the date of issuance of Annexure A6, after their seniors absorbed by Annexure-A6. Hence the refusal to grant them absorption with effect from the due date is illegal, arbitrary, discriminatory and violative of Art.14 and 16 of the Constitution of India. The applicants are actually working in the same pay scale as that of the unskilled labourer {now MTS(industrial)}. But they are entitled to have their fixation of pay and other service benefits antedated to the actual date of eligibility. The applicants are entitled to be granted benefits as if the right thing was done at the right time. The refusal to do so is discriminatory, 2025.11.26 V R ARUNKUMAR 10:41:49 +05'30' 47 O.A Nos. 180/00305/2022, 3/2024, 72/2024 & 211/2024 illegal, arbitrary, unjust and unfair. It is violative of Art.14 and 16 of the Constitution of India.
The fixation of pay under FR 22(1)(a)(1) is due when a person is appointed from one post to another post having higher duties and responsibilities. The duties and responsibilities of Unskilled Labourer {MTS(industrial)} is higher than that of Group D{MTS(non-industrial)}. In fact earlier the benefit of fixation under FR 22(1)(a)(1) used to be given to those absorbed as Unskilled Labourers. The refusal to grant the same benefit to the applicant is discriminatory, illegal, arbitrary, unjust and unfair. It is violative of Art.14 and 16 of the Constitution of India.
4.2 The learned counsel for the applicants have relied on the following judgement of the Hon'ble Apex Court:- Subhash Chander Mittal v. Bhagwant Singh Dhanada and others dated 26.09.1997 {(1998) 9SCC 713}; Vikas Pratap Singh and others v. State of Chhattisgarh and others {(2013) 14 SCC 494} 4.3 Learned counsel for the applicants has claimed that 235 vacancies were pre-existing (Annexure A6) for absorption. Initially 167 vacancies were notified vide notification dated 16.02.2012 (Annexure-A2). As per the existing Rules of 2025.11.26 V R ARUNKUMAR 10:41:49 +05'30' 48 O.A Nos. 180/00305/2022, 3/2024, 72/2024 & 211/2024 year 2000, notification dated 16.02.2012 (Annexure-A2) was issued for selection of candidates for absorption. It is noted that Annexure-A2 does not specify number of vacancies. Thereafter, notification was issued for the purpose of direct recruitment for skilled labourer on 01.06.2012 (even prior to publication of Recruitment Rules 2012 on 09.06.2012) by Ministry of Defence Annexure-A4. Subsequently, vacancies were increased to 235 (167 published earlier and 68 increased vacancies) Annexure-A6 dated 16.11.2012. The argument forwarded by the applicants that these vacancies were available for absorption as per the old Recruitment Rules 2010. As per revised Recruitment Rules of year 2012, mode of entry was limited to only direct recruitment. Therefore, the Naval establishment could have absorbed these applicants on 28.12.2015 against vacancies existing prior to June 2012 Recruitment Rules notification. Therefore, they are entitled to benefit of absorption with effect from 1 st batch of absorbees i.e. with effect from 17.08.2012.
4.4. The official respondents in their reply statement have further submitted that in accordance with the memorandum dated 16.02.2012 issued by the 3 rd respondent, 56 eligible employees were absorbed to the post of Tradesman Mate (erstwhile Unskilled Labourer) on 17.08.2012. Subsequently, revised Recruitment 2025.11.26 V R ARUNKUMAR 10:41:49 +05'30' 49 O.A Nos. 180/00305/2022, 3/2024, 72/2024 & 211/2024 Rules for the post of Multi-Tasking Staff (Industrial) (erstwhile Unskilled Labourer/now Tradesman Mate) was promulgated vide SRO 43/2012, in which the method of filling up of vacancies was 'by Direct Recruitment' only. Hence, post absorption of 56 eligible employees, direct recruitment action was initiated for the remaining 235 vacancies in the post of Tradesman Mate in terms of the revised Recruitment Rules.
4.5 From the above para it may be inferred that after absorption of 1 st slot of 56 eligible employees (5 years service) on 17.08.2012, balance 235 vacancies are to be filled up by direct recruit action in terms of revised Recruitment Rules 2012. Subsequently, 100 employees in erstwhile Group 'D' who did not have 5 years service but passed 8th standard were absorbed in compliance of the judgement of the Hon'ble High Court in OP(CAT) No.37/2014 on 14.09.2015. 4.6 Thereafter, few similarly situated eligible employees approached Tribunal to extend the benefit of the judgement of the Hon'ble High Court of Kerala in OP(CAT) 37/2004. Accordingly, 49 similar situated employees were absorbed on 28.12.2015.
2025.11.26 V R ARUNKUMAR 10:41:49 +05'30' 50 O.A Nos. 180/00305/2022, 3/2024, 72/2024 & 211/2024 4.7 However, party respondents, who are applicant in OA No.3/2024 highlighted that only 167 vacancies were available for absorption as per Annexure A-3 against which 56 and 100 absorption were done on 17.08.2012 and 14.09.2015. After their absorption direct recruitment for 165 posts were done from 15 to 18th September, 2015. The absorption of 49 persons on 28.12.2015 is irregular as only mode of recruitment should have been direct recruitment. But they are not challenging at this stage their absorption. 4.8 It was pleaded by the party respondents that employees who were absorbed on 14.09.2015 are senior to direct recruits ( 15/09/15 to 18/09/15) by virtue of their earlier date of joining. Now if this benefit is given to these absorbees dated 28.12.2015, it will adversely affect seniority of direct recruits. The party respondents cited judgement of the Hon'ble Supreme Court in Kerala State Electricity Board v. Sasidharan in 2020(3) KLT 514 dated 28.09.2015:-
"11. On the other hand Sri. P.M. Pareeth appearing on behalf of the writ petitioner submits that, even assuming for the sake of argument that there has been an erroneous decision by the Board or a mistake in promoting the petitioner to the relevant posts, petitioner had carried out the work properly for the last several years and it is not open for the Board to cancel the promotions already granted and to recover the excess pay from the petitioner and to refix the pay accordingly. He relied upon various judgments of the High Court and contended that his case is 2025.11.26 V R ARUNKUMAR 10:41:49 +05'30' 51 O.A Nos. 180/00305/2022, 3/2024, 72/2024 & 211/2024 clearly covered by the "sit back theory" applied by the Courts in respect of promotions granted over a long period of time.
(i) Reference is made to the Full Bench judgment in Sreedharan Pillai v. State of Kerala Ors. (1973 KLT 151 (F.B.)) wherein Full Bench of this Court observed that it is neither just nor equitable to deprive persons who have been promoted many years ago of the rights that have accrued to them regarding their rank and seniority by purporting to conduct a review of the promotions after lapse of many years. That was a case in which a person was promoted based on an existing rule which was later on amended. Without taking note of the said amendment, promotion was effected. Subsequently, after several years, the promotions were interfered with. In the background of the aforesaid case, the Full Bench had occasion to observe that the promotions granted shall not be disturbed after a considerably long period........"
"16. The principle of 'sit back theory' has been accepted by the Supreme Court long back. This Court also has followed the same in a number of decisions. The earliest decision of the Supreme Court in this respect is the one reported in Rabindra Nath Bose & Ors v. Union of India & Ors. (1970 KLT OnLine 1201 (SC) = AIR 1970 SC 470). In that decision the Supreme Court held as follows:
"Each person ought to be entitled to sit back and consider that his appointment and promotion effected a long time ago would not be set aside after a lapse of a number of years."
The above decision was followed by this Court in 1973 KLT 151 (F.B.). This Court observed that no statutory appeals or revision petitions are shown to have been filed against the orders of promotion and it must be taken that those lists had become final. It is not in the interests of the maintenance of the morale, efficiency and contentment in 2025.11.26 V R ARUNKUMAR 10:41:49 +05'30' 52 O.A Nos. 180/00305/2022, 3/2024, 72/2024 & 211/2024 the service to disrupt after such long lapse of time matters pertaining to vital service conditions like Seniority and rank which have already become settled. Thus it is quite clear that it will be unjust to deprive persons who had been promoted many years ago of the rights that had accrued to them regarding rank and seniority by purporting to conduct a review of the Promotion after the lapse of many years......."
4.9 They also cited the judgement of the Hon'ble Supreme Court in Shiba Shankar Mohapatra and others vs. State of Orissa and others {(2010) 12 SCC 471} and highlighted para29 of the judgement "29. It is settled law that fence-sitters cannot be allowed to raise dispute or challenge the validity of the order after its conclusion. No party can claim the relief as a matter of right as one of the grounds for refusing relief is that the person approaching the court is guilty of delay and the laches. The court exercising public law jurisdiction does not encourage agitation of stale claims where the right of third parties crystallises in the interregnum. (Vide Aflatoon v. Lt. Governor of Delhi ; State of Mysore v. V.K. Kangan; Municipal Council, Ahmednagar v. Shah Hyder Beig; Inder Jit Gupta v. Union of India; Shiv Dass v. Union of India; A.P. SRTC v. N. Satyanarayana and City and Industrial Development Corpn. v. Dosu Aardeshir Bhiwandiwala) 5.1 Applicants in OA 3/2024 submitted that after the implementation of the aforesaid Annexure A-9 order (this Tribunal order in OA 835/2016), some of the absorbed Tradesman Mates (TDMs) recruited later on 28.12.2015, approached 2025.11.26 V R ARUNKUMAR 10:41:49 +05'30' 53 O.A Nos. 180/00305/2022, 3/2024, 72/2024 & 211/2024 the Naval authorities for ante-dating their seniority. But this was not accepted by the Naval authorities. A true copy of the Memorandum No.CS 2764/1/70 dated 19.04.2023 is produced herewith and marked as Annexure-A10. However, a few months later, the Naval authority volte-faced and revised the settled seniority list of 2015 and 2016 in 2023 and that too without hearing the affected parties. A true copy of the Memorandum No.CS 2764/1/70 dated 25.09.2023 is produced herewith and marked as Annexure A-11. As per the aforesaid decision the Seniority List was revised. In the revised Seniority List the direct recruited applicants are lowered in seniority and placed at Sl.No.55 to 725 and party respondents 5 to 41 are placed before the applicants from Sl.No.397 onwards. The applicants were brought down from the earlier allotted seniority of 2015 and placed below the absorbed TDMs who were arrayed as Respondents No.5 to 41 and recruited later than the applicants. The revision of the settled seniority list of 2015 and 2016 in 2023 is illegal and arbitrary. The applicants had submitted a representation against this illegality, but the official respondents are going ahead with the DPC for further promotions based on the revised seniority list. The illegally recruited respondents are now unsettling the settled seniority after long time with the connivance of the official respondents and it is liable to be deprecated by this Tribunal.
2025.11.26 V R ARUNKUMAR 10:41:49 +05'30' 54 O.A Nos. 180/00305/2022, 3/2024, 72/2024 & 211/2024 5.2 The seniority lists which were published in 2015 and 2016 remain unchallenged for a long time and the seniority was settled. Relying on the doctrine of 'sit back theory' the Hon'ble Apex court held that settled seniority cannot be unsettled after the lapse of a reasonable period. The Hon'ble Apex Court had observed that a person who enjoyed a seniority position for quite a long time is entitled to sit back and allowing a person, who slept over his right, to rake up a stale claim, tinker with the seniority list is against the interest of administration and will demoralize other members of the service. The same principles would squarely apply to the factual situation in the present case and a belated challenge to a settled position of seniority and consequential revision of Seniority list of 2015 in 2023 is illegal and liable to interfered. 5.3 The absorbed TDM respondents who did not challenge the seniority list in their cases and acquiesced into the same and woke up after long delay only because of the reason that their counterparts who had approached the Tribunal earlier in time succeeded in their efforts, then such employees cannot claim that the benefit of the order in OA No.835/2016 dated 21.12.2021. They would be treated as fence-sitters and laches and delays and the acquiescence would dismiss their claim. The absorbed TDM respondents were previously working as 2025.11.26 V R ARUNKUMAR 10:41:49 +05'30' 55 O.A Nos. 180/00305/2022, 3/2024, 72/2024 & 211/2024 Ministerial staff of non-technical post and TDM is a technical post. The respondents did not acquire any experience in the TDM post to claim the seniority above the applicants, since they joined later than the applicants. The mandatory requirement of minimum qualifying service for promotion cannot be equated with their previous service in the ministerial cadre. 5.4 The party respondents in their reply statement further submitted that the seniority lists referred in the OA were not at all circulated at the proper time. These respondents as also the applicants were in different units and it was not possible to easily know the wrong grant of seniority. Even otherwise, the benefit of absorption from 2012 was granted to others similarly placed only now. Thus there is no delay in claiming such absorption by these respondents, based on their claim for treatment on par with those absorbed pursuant to Annexure-A5. (Judgement of Hon'ble High Court of Kerala in OP(CAT) 37/2014 dated 08.07.2014) 6.1 Applicants in OA 72/2024 submitted that on the basis of the judgement of the Hon'ble High Court of Kerala in OP(CAT) No.37/2014, the petitioners therein in the original petition were appointed to the vacancies occurred prior to 2025.11.26 V R ARUNKUMAR 10:41:49 +05'30' 56 O.A Nos. 180/00305/2022, 3/2024, 72/2024 & 211/2024 09.06.2012, the date on which the Recruitment Rules 2012 came into force. Accordingly, in the remaining post, the applicants herein were appointed on different dates such as on 15.09.2015, 16.09.2015, 17.09.2015 and 18.09.2015, as evidenced in Annexure-A1 to A-4 orders in terms of the direction in Annexure- A5 judgement. On the basis of the appointment made by absorption, in terms of the directions in the Annexure A-5 judgement and the appointment by direct recruitment in Annexure-A1 to A-4 appointment orders and subsequently made appointments, the Naval Establishment has maintained as seniority list of the Tradesman Mate (TDM) from 2015 onwards. True copy of the relevant pages of the Seniority List of TDM as on 1 st November 2015 is produced and marked as Annexure-A6. The seniority lists for the subsequent years in the category have been published from time to time. True copy of the relevant pages of the Seniority List, as on 2016 is produced and marked as Annexure-A7. True copy of the relevant pages of the Seniority List published as on 2020 is produced and marked as Annexure-A8.
6.2 It can be seen that through Annexure-A9 to A23, many of the applicants herein been have promoted to their immediately higher posts, even in two level promotions they have enjoyed so far. Also, separate seniority lists are 2025.11.26 V R ARUNKUMAR 10:41:49 +05'30' 57 O.A Nos. 180/00305/2022, 3/2024, 72/2024 & 211/2024 published and in force, apart from Annexure-A6 to A8 seniority lists published so far in the entry posts, in the skilled labour/ technical posts, which many of the applicants presently occupy.
6.3 It is on the basis of Annexure-A24, some of the employees in the cadre of Unskilled Labourer/Tradesman mate, who are junior to the applicants herein have submitted the representation seeking the parity with the applicants in Annexure-A24 final order and requested their seniority should have been revised from the date of seniority granted to the applicants in Annexure-A24 final order. This representation was rejected by an order dated 19.04.2023. True copy of the Memorandum No.CS 2764/1/70 dated 19.04.2023 is produced and marked as Annexure-A25. It can be seen that in Annexure-A25, it was categorically held that the court order is applicable only to the applicants and therefore requests of non- petitioners cannot be acceded to.
6.4 By that time, the seniority list in Annexure-A6, A7 and A8 have become final, as there was no objection against the seniority list from any of the workers or even the promotion granted in Annexure-A9 to A23 orders with respect to the applicants herein were unchallenged and became final. However, to the utter 2025.11.26 V R ARUNKUMAR 10:41:49 +05'30' 58 O.A Nos. 180/00305/2022, 3/2024, 72/2024 & 211/2024 surprise of the applicants herein, on 25.09.2023, an order was communicated stating that as per the 23 rd Steering Committee meeting of JCM IV level council on 17.08.2023, the competent authority has decided to consider the similarly situated employees also in addition to the applicants of OA for the same in order to avoid further litigation and frequent review of DPCs. Accordingly, it was decided to revise the seniority list from 2013 to 2016 and review DPCs. True copy of the revised Seniority List as on 31.12.2015 in Tradesman Mate is produced and marked as Annexure-A28. True copy of the revised Seniority List as on 31.12.2016 in Tradesman Mate is produced and marked as Annexure-A29. However, now it has been decided to reject the objections of the applicants and finalize the revised seniority list in Annexure-A28 and A29, by enforcing the directions to all the workers who were appointed through absorption and that too upsetting the seniority of the applicants herein. It is also relevant to note that the seniority of the applicants, as per Annexure A-6 to A8 seniority lists and the promotion granted as per Annexure-A9 to A23 are final but in terms of Annexure-A26 and A27, not it has been decided to revise by causing prejudice to the applicants herein.
6.5 The Hon'ble Supreme Court in several decisions has categorically held that 2025.11.26 V R ARUNKUMAR 10:41:49 +05'30' 59 O.A Nos. 180/00305/2022, 3/2024, 72/2024 & 211/2024 when a seniority list, which continued to be in existence for a long time, it cannot be disturbed, whatever be the merit in the hands of the late comer. In K.R. Mudgal and Ors. v. R.P. Singh, reported in AIR 1986 SC 2086, it was held that it is essential that anyone who feels aggrieved by the seniority assigned to him, should approach the Court as early as possible otherwise in addition to creation of sense of insecurity in the mind of Government servants, there shall also be administrative complication and difficulties. So the decision in Annexure-A27 and A26 to disturb the seniority of the applicants, highlighting Annexure-A24 final order of this Tribunal is highly vitiated and against the settled principles of law. 6.6 Applicants have relied on the following judgments of the Hon'ble Supreme Court on seniority:- Annes K.A. And another v. State of Kerala and others - 2017 (5) KHC 803 dated 01.03.2017; State of Uttar Pradesh and others v. Ashok Kumar Srivastava and Another {2014 (14) SCC 720} dated 21.08.2013; K.A. Abdul Majeed v. State of Kerala and others {2001(6) SCC 292} dated 07.08.2001; Jagdish Lal and others v. State of Haryana and other { 1997 (6) SCC 538} dated 07.05.1997 and K.R. Mudgal and others v. R.P. Singh and others 1986 (4) SCC 531 dated 30.09.1986.
2025.11.26 V R ARUNKUMAR 10:41:49 +05'30' 60 O.A Nos. 180/00305/2022, 3/2024, 72/2024 & 211/2024 6.7 The party respondents made similar plea, which has been submitted in OA No.3/2024. The official respondents have filed an adoption memo stating that they adopt the reply statement filed in OA No.305/2022 in the present OA as reply statement filed on behalf of Respondents 1 to 9, in the interest of justice. 7.1 Applicants in OA 211/2024 submitted that Party Respondents 5 to 27 and others seeking seniority with retrospective effect above the applicants and similarly placed candidates was rejected by the department on 19.04.2023 (Annexure A-6). Thereafter, by Annexure-A7 proceedings dated 25.09.2023 the settled seniority has been revised with retrospective effect from 2015 onwards. The applicants and similarly placed incumbents and directly recruited Trades Man Mate have been superseded. The representations submitted by the applicants and other aggrieved persons have been rejected by Annexure-A11, A12 and A13 proceedings.
7.2 Applicants have relied on following judgements of the Hon'ble Supreme Court and Hon'ble High Court of Kerala:- Ravi Chandran v. Union of India 2009 (4) KLT SN 66(C.No.57) SC dated 17.11.2009; Ramesh K. Sharma and Another v. Rajasthan Civil Services and others (2001) 1 SCC 637 dated 23.11.2000; AIR 2025.11.26 V R ARUNKUMAR 10:41:49 +05'30' 61 O.A Nos. 180/00305/2022, 3/2024, 72/2024 & 211/2024 1990 Supreme Court 1607; A.R. Antulay v. R.S. Nayak and another - AIR 1988 Supreme Court 1531; M/s Bhagwan Dass & Co. Pvt. Ltd v. The State of UP and another -AIR 1981 Supreme Court 41; Rabindra Nath Bose and others v. Union of India and others - AIR 1970 Supreme Court 470; T.C. Sreedharan Pillai & Others v. State of Kerala & Others- 1973 KLT 151 (F.B.) 7.3 The official respondents have filed an adoption memo stating that they adopt the reply statement filed in OA No.305/2022 in the present OA as reply statement filed on behalf of Respondents 1 to 4, in the interest of justice. 7.4 In the rejoinder the applicants have submitted that they had been officiating the said post from 14.09.2015 onwards with duties and responsibilities attached to the substantive posts. The posts are substantive in nature. By virtue of the said absorption, the applicant had acquired a right to have their ranks and seniority in that category reckoned on the basis of the principle of seniority. Their position in relation to absorption had been settled at least by Annexure-A16 order. No statutory appeals or revision petitions are shown to have been filed against the said order and hence it must be taken that the position and seniority had become final. It is not in the interest of the maintenance of the morale, 2025.11.26 V R ARUNKUMAR 10:41:49 +05'30' 62 O.A Nos. 180/00305/2022, 3/2024, 72/2024 & 211/2024 efficiency and contentment in the service to disrupt after such a long lapse of time matters pertaining to vital service conditions like seniority and rank which have already become settled. The Apex Court in AIR 1970 SC p.478 (Rabindra Nath Bose) observed as follows: 'Each person ought to be entitled to sit back and consider that his appointment and promotion effected a long time ago would not be set aside after a lapse of a number of years'. Therefore, it will be neither just nor equitable to deprive persons who have been absorbed many years ago, of the right that have acquired to them regarding their rank and seniority by purporting to conduct a review of seniority/absorption after a lapse of many years. 8.1 During the final oral arguments, learned counsel for the applicants in OA No.305/2022 pleaded for ante-dating the date of absorption to 17.08.2012 on the premise that 235 vacancies were available prior to RR revision in June 2012. Moreover, as per revised Recruitment Rules-2012, direct recruitment was the only mode of entry, in compliance of the orders of the Hon'ble High Court of Kerala, absorption has been done in December 2015, which could have only been possible against vacancies available for absorbees. This has been reaffirmed by the respondents in the reply statement vide para5 of their submission.
2025.11.26 V R ARUNKUMAR 10:41:49 +05'30' 63 O.A Nos. 180/00305/2022, 3/2024, 72/2024 & 211/2024 8.2 Conceding settled principle of 'sit-back' as pronounced by the Hon'ble Apex Court in multiple judgements, the learned counsel agreed that no challenge to Seniority List published in 2015, 2016 and 2022 was made by the applicants and they were not borne on Group 'D' skilled cadre prior to 28.12.2015 and thereafter, a large number of promotions have already been done as per Seniority Lists published in year 2015, 2016 and 2022. Therefore, disturbing Seniority List at this stage may not be administratively feasible. However, the financial benefit of ante-dating absorption must be granted. 8.3 Learned counsel for the applicants in OA 3/24 orally submitted that though absorption in December 2015 was irregular, they are not challenging it. They are only pleading to maintain their seniority position just below absorbees of 14.09.2015 as per Annexures A6 to A8.
8.4 Learned counsel for the applicants in OA No.211/2024 also orally argued that their pleading is also primarily confined to maintain their seniority above Direct Recruits (15.09.2015 to 18.09.2015) and absorbees of 28.12.2015. 9.1 Arising out of the above Original Applications reliefs sought therein and 2025.11.26 V R ARUNKUMAR 10:41:49 +05'30' 64 O.A Nos. 180/00305/2022, 3/2024, 72/2024 & 211/2024 reply statements/rejoinders made by the applicants and the respondents and numerous Original Applications filed by different set of employees and associations in this Tribunal, Hon'ble High Court and Hon'ble Supreme Court and orders thereon, following points emerged for adjudication in respect of following set of employees:-
(i) 56 persons, absorbed on 17.08.2012 (Annexure A-5, in OA No.305/2022)
(ii) 100 persons absorbed on 14.09.2015 (Annexures A-11 and A-12 in OA No.305/2022)
(iii) Direct Recruits
(a) 33 candidates on dated 15.09.2015 ( Annexure A-1 in OA No.72/2024)
(b) 41 candidates on 16.09.2015 (Annexure A-2 in OA No.72/2024)
(c) 45 candidates on 16.09.2015 (Annexure A-3 in OA No.72/2024 )
(d) 46 candidates on 18.09.2015 (Annexure A-4 in OA No.72/2024 ) Total 165 candidates
(iv) 49 persons, absorbed on 28.12.2015 (Annexure A-13 of OA No.305/2022) 9.2 Issue No.1:

Respondents OM dated 25.09.2023 Annexure-A11 (OA 03/2024) which has been issued with the expected outcome of OA No.305/2022, which is under prosecution.
10.1 Annexure A-2 notification dated 16.02.2012 (OA No.305/2022) does not specify the number of vacancies to be filled up through absorption against which 56 persons (with 5 years experience) were absorbed on 17.08.2012, prior to revision in Recruitment Rules 2012. 167 vacancies were notified for direct recruitment on 09.06.2012 which were increased to 235 vide corrigendum dated 16.11.2012. Both the notifications were stayed by the Hon'ble High Court of Kerala in OP(CAT) No.37/2014. Subsequently, 100 absorption were made on 14.09.2015, who had direct recruit qualifications. Thereafter, from 15-18 th September, 2015, 165 persons were directly recruited. Naval establishment however absorbed 49 persons on 28.12.2015 after this direct recruitment. The respondent have failed to clarify the number of vacancies available for absorption prior to June 2012 notification, in their reply statement or in their pleadings. Since this absorption has been made by Naval establishment after promulgation 2025.11.26 V R ARUNKUMAR 10:41:49 +05'30' 67 O.A Nos. 180/00305/2022, 3/2024, 72/2024 & 211/2024 of revised Recruitment Rules which envisaged entry through direct recruit route only. It may be presumed that these absorptions on 28.12.2015 have been made against vacancies available for absorption prior to June 2012. Considering the above, the date of absorption in respect of 49 absorption made on 28.12.2015 can be ante-dated to 17.08.2012.
10.2 Since they were not borne on the cadre of the Skilled category and working in non-skilled posts prior to 28.12.2015 only notional benefit of pay fixation can be granted and the actual benefit from the actual date of absorption on or after 28.12.2015. It is settled principle that persons who is not borne on the cadre cannot claim seniority. Therefore, no seniority benefit can be granted to them prior to actual date of absorption in the skilled cadre. 10.3 The seniority lists were published as on 01.11.2015 and as on 31.12.2016 in the year 2015 and 2016 respectively, a decade back and subsequently large number of promotions have been granted to employees absorbed or directly recruited during the intervening period, disturbing the seniority at such a later date shall be in violation of well established principle of 'sit back' as propounded by the Hon'ble Apex Court in numerous judgements 2025.11.26 V R ARUNKUMAR 10:41:49 +05'30' 68 O.A Nos. 180/00305/2022, 3/2024, 72/2024 & 211/2024 cited.
10.4 As late as 19.04.2023 the Naval Headquarters Southern Command has consistently taken a stand that employees who were absorbed on 14.09.2015 and direct recruits ( recruited on 15 to 18.09.2015) are senior to absorbees of 28.12.2015. The relevant paragraph is reproduced below:-
"In accordance with the Hon'ble CAT(Ekm) directive in OA 835/2016 filed by Shri Riju M Madhavan and 14 others, draft list of revised seniority of TDM from the year 2012 to 2015 were published vide this Headquarters Memoranda under reference for information of all concerned. In this regard, representations have been received from many industrial employees with a request to extend the benefits of above court order in their case also to refix their seniority. The representations have been examined and it is intimated that the court order is applicable only to the applicants and therefore requests of non-petitioners cannot be acceded to. It is therefore requested that the individuals concerned be informed accordingly."
10.5 However, following Minutes of the 23 rd Steering Committee Meeting of JCM IV Level Council held on 17.08.2023 vide Naval Headquarters, Southern Command letter No.CS1311/4 dated 25.09.2023, the seniority list has been revised under the premise that 8 employees absorbed on 28.12.2015 have filed OA No.305/2022 based on the order of this Tribunal in OA No.835/2016 for extension of the benefits of the order in the ibid OA and the same is likely to be 2025.11.26 V R ARUNKUMAR 10:41:49 +05'30' 69 O.A Nos. 180/00305/2022, 3/2024, 72/2024 & 211/2024 allowed by the Tribunal. Obviously, the revised seniority lists will have to be again reviewed for re-appropriation of the above mentioned 8 employees and will result in review of DPCs also. Likewise, other similarly situated employees, who were absorbed to the post of TDM on 14.09.2015 and 28.12.2015in compliance to the judgement of the Hon'ble High Court of Kerala in OP(CAT) 37/2014 and connected cases are also likely to approach the Tribunal for similar benefits. 10.6. Presuming the outcome of the judgement of this Tribunal, on flawed logic the seniority lists (published in 2015, and 2016 earlier) have been revised placing the absorbees of 28.12.2015 above the direct recruits of 15 th -18th September, 2015 without any directions of this Tribunal or the Hon'ble High Court of Kerala. This order defies logic and settled principle of 'sit back' and 'fence-sitters'.
10.7 This is tantamount to giving the benefit to fence-sitters (absorbees of 28.12.2015) who never challenged the seniority published in 2015, 2016 earlier and who were not even born on the cadre till 28.12.2015; without any directions of this Tribunal or Hon'ble High Court of Kerala. This order dated 25.09.2023 (Annexure A11 of OA No.3/2024) is liable to be set aside along with any 2025.11.26 V R ARUNKUMAR 10:41:49 +05'30' 70 O.A Nos. 180/00305/2022, 3/2024, 72/2024 & 211/2024 consequential adverse impact on seniority and promotions of absorbees and direct recruits who were born on cadre prior to them.
11. Considering the above, the oral pleadings and arguments and settled principle of 'sit-back', we dispose off the OAs with the following directions:
(i) Absorption of applicants in OA No.305/2022 is ante-dated to 17.08.2012 with notional benefit of pay fixation and actual benefit from their date of actual absorption to the post on or after 28.12.2015 without any seniority benefit prior to that.
(ii) The principle of seniority followed in seniority lists published in 2015, 2016 and 2022 as available in Annexures A6 to A-8 of OA No.03/2024 stands ratified.
(iii) The impugned OM No.CS 2764/1/70 dated 25.09.2023 revising Seniority Lists, placing absorbees of 28.12.2015 above direct recruits, Annexure-11 (in OA No.03/2024) and revised seniority lists published (Annexures-A12 & A-13 in OA No.03/2024) are set aside.
