2. Mr. Akshay Latwal, learned AGA, for the State of Uttarakhand/1.
3. The present criminal miscellaneous application filed under C528 of BNSS against the Respondent No.2 - SriAhsan Ali, is with a prayer that the chargesheet dated 09.11.2024, as well as the cognizance and summoning order dated 22.03.2025, passed by the learned Judicial Magistrate, Kashipur, District Udham Singh Nagar, and the entire proceedings in Criminal Case No.75 of 2025, "State Vs. Sunil Chhabra and others", for the offences under Sections 504, 506, 420 and 120-B of IPC, pending before the court of learned Judicial Magistrate, Kashipur, District Udham Singh Nagar be quashed.
4. On behalf of the Applicants, stay application (IA No.1/2025) has also been filed as paper no.33, with a prayer that during the pendency of this criminal miscellaneous application, the proceedings may be stayed.
5. Admit.
6. Issue notice to the Respondent No.2. Steps to be taken within a week. Counter affidavit to be filed within a period of three weeks.
7. Till the next date of listing, the entire proceedings of Criminal Case No.75 of 2025, "State Vs. Sunil Chhabra and others", for the offences under Sections 504, 506, 420 and 120-B of IPC, pending before the court of learned Judicial Magistrate, Kashipur, District Udham Singh Nagar, shall remain stayed.
8. List this matter on 07th October, 2025.
