Heard Mr. Baxi S.R.P. Sinha, the learned senior counsel for the appellant, Mr. Ashwani Kumar Sinha, the learned APP, and Mr. Amrit Anunay, the learned counsel for the informant, on I.A. No. 2654 of 2018, which is filed on behalf of the sole appellant for suspension of sentence and grant of bail during the pendency of this appeal.

The prayer for suspension of sentence and grant of bail was earlier rejected twice by this court. The allegation against the appellant is that when the informant was caught by other accused persons the appellant made all attempt to put bottle filled with conc acid in the mouth of informant but since informant shut his mouth the appellant poured acid over the Patna High Court CR. APP (DB) No.511 of 2014(4) dt.27-02-2019 2/2 mouth of informant causing burn injuries on face, eye and neck. The informant himself deposed in the court also and the medical evidence corroborates the testimony of the informant.

Considering the facts that it is a case of acid attack causing grievous injury on all vital parts of the body of informant, we are not inclined to enlarge the appellant on bail.

Accordingly, I.A. No. 2654 of 2018 stands dismissed.
