Section 159 in Bihar Board's Miscellaneous Rules, 1958
159. Temporary ministerial establishment for Additional Deputy or Sub-Deputy Collectors.
- There is a sanctioned scale of Deputy and the Sub-Deputy Collectors for each headquarters and sub-divisional office and the permanent ministerial establishments are fixed with reference to the normal work of the office and the sanctioned scale of Deputy and Sub-Deputy Collectors. When Additional Deputy or Sub-Deputy Collectors are posted on general duty to district or sub-divisional headquarters additional temporary ministerial establishment is admissible at a rate not exceeding one clerk for each provided that no clerk should be appointed for any such officer whilst under training--an officer being considered under training until he passed the departmental examination by the lower standard completely. A temporary clerk may, however, be appointed for every additional temporary or probationary Deputy or Sub-Deputy Collector vested with magisterial powers irrespective of the fact whether he has passed the departmental examination by, the lower standard or not. The pay of these clerks will be at a fixed rate of [Rs. 50] [Now Rs. 1200.] each a month but if the posts of temporary clerks are likely to exist for more than a year they will draw the time-scale of pay of [Rs. 50-2-70-EB-2-90] [Now Rs. 1200-30-1800.] each a month. When an Additional Deputy or Sub-Deputy Collector is transferred and is not replaced his extra establishment may not be retained for more than two months unless his place is filled at the end of that period.This Rule does not apply in the cases of Deputy Collectors engaged on settlement, partition or land acquisition for whose special temporary establishments separate rules exist in the Manuals relating to those branches of work.
