17.10.2025 Heard Mr. U.J. Saikia, learned counsel for the petitioner and Mr. P.S. Lahkar, learned Addl. Public Prosecutor for the State.
By this application, the petitioner has prayed for bail in connection with Azara P.S Case No. 142/2025 registered under Section 192(2)/190/296/325(5)/109(1)/132 BNS, 2023 read with Section 3 of Prevention of Damage to Public Property Act, 1994.
The FIR dated 21.09.2025 reflects that on the day when the body of late Zubeen Garg had arrived at the LGBI Airport, an unruly mob attacked the police personnel who were stationed there for law & order situation and that they also attacked the vehicle of one police personnel and broke the rear side glass as well as front windshield. The attack by the unruly mob was stated to have started at around 12:30 AM and at 6:30 AM on the same day, it was also alleged that the unruly mob attacked the media personnel. During the investigation, the police arrested the petitioner who is stated to have led the mob into doing the said unruly things. The petitioner was also found at the place of the occurrence by the camera Page No.# 3/4 footage.
The counsel for the petitioner states that the petitioner was not there when the unruly mob started to attack the police personnel and had reached the place of occurrence later and that he had no connection with leading the mob or attacking the vehicle of the police personnel concerned.
Mr. P.S. Lahkar, learned Addl. Public Prosecutor submits that on perusal of the Case Diary more so from the statement of the petitioner that there was someone else who was involved with the crime and who had instigated other person gathered there and caused the entire incident.
In view of the submissions made at the bar and in view of the materials available on the Case Diary, this Court finds it fit to release the petitioner on bail on furnishing a bail bond of Rs. 20,000/- with one (1) local surety of the like amount to the satisfaction of the learned CJM, Kamrup (M) under the following conditions:-
(1) The petitioner shall cooperate with the investigation and appear before the learned CJM, Kamrup (M) as and when called for. (2) The petitioner shall not tamper with the evidence or influence any of the witnesses.
(3) The petitioner shall not leave the jurisdiction of the learned Page No.# 4/4 CJM, Kamrup (M) without the permission of the said Court.
Petition is disposed of.
