          State.

This bail application has been filed on behalf of the abovenamed applicant with prayer to release on bail in connection with Patratu (Bhurkunda) P.S. Case No.120 of 2022 registered under Sections 461, 379/34 of the Indian Penal Code pending in the court of learned Chief Judicial Magistrate, Ramgarh.

Learned counsel for the applicant has submitted that as per F.I.R. allegations, the unknown thieves had committed theft of several article including pump and other parts from water supply museum, the details of which is given in the F.I.R.

Learned counsel for the applicant has submitted that the name of the applicant transpired during investigation. The stolen copper wire is alleged to be recovered from the bush on the confessional statement and pointing out of the applicant. Indeed the alleged recovery has been planted of which there is no independent witness. It is further submitted that there is no cogent evidence against the applicant to show his complicity in commission of the alleged offence and he has been languishing in jail since 6th July, 2022.

Learned A.P.P. appearing on behalf of the State vehemently opposed the contentions made by the learned counsel for the applicant and contended that the applicant is having criminal antecedent.

In view of the submissions made and materials on record, the bail application of the applicant is hereby allowed. Let the applicant be released on bail on furnishing bail bond of Rs.20,000/-(Rupees Twenty Thousand) with two sureties of the like amount to the satisfaction of the court concerned in aforesaid case.
