Heard through video conferencing.

The petitioner is seeking regular bail in FIR No.182 dated 07.12.2018, under Sections 21 and 22 of the NDPS Act, registered at Police Station C Division, District Amritsar.

Learned counsel for the petitioner contends that the allegations against the petitioner are that 735 capsules of Parvon Spas Plus containing tramadol were allegedly recovered from the petitioner. The petitioner is in custody for over a year and is not involved in any other case under the NDPS Act. She also contends that co-accused namely Rattandeep Singh alias Sunny has been granted regular bail by the Coordinate Bench of this Court in CRM- M-52744-2019 on 12.02.2020.

Learned State counsel has filed the custody certificate which indicates that the petitioner is in custody for over a year. He upon instructions from Sub Inspector Gulwinder Singh states that although the challan has been filed but none of the prosecution witnesses have been examined so far.

In view of the submissions of learned counsel for the petitioner, especially when the petitioner is in custody for over a year, he is not involved in any other case under the NDPS Act, co-accused has been granted bail, Covid 19 pandemic and the conclusion of the trial is likely to take some time, I deem it a fit case to grant the concession of regular bail to the petitioner.

Therefore, without expressing any opinion on the merits of the case, the petition is allowed. The petitioner is ordered to be released on regular bail on his furnishing requisite bonds to the satisfaction of the trial Court/Duty Magistrate concerned.
