1. Heard counsel for complainant.
2. Above complaint has been filed for directing the opposite parties to refund the money deposited by the members of the complainant with interest @ 18% per annum from the date of respective deposit till the date of payment, (ii) to pay Rs.5 lacs to individual members of the complainant as compensation for mental agony and harassment, (iii) to pay Rs.20000/- to the individual members of the complainant as litigation charges and (iv) any other relief which is deemed fit and proper in the facts of the case.
3. The complainant stated that M/s TGS Constructions (P) Ltd., opposite party no.1 was a company registered under the Companies Act, 1956 and engaged in the business of development and construction of group housing project and opposite parties no.2 to 5 were its Directors. The opposite party advertised different group housing projects in Bengaluru. Wide publicity had been made in print and electronic media. Believing upon the representation of the opposite parties, members of the complainant booked flats/plots in different projects. A table relating to money deposited by the complainants is given below:

4. This money was deposited in the year 2014-2016. Later on, it was noticed by the members of the complainant that the opposite party has neither acquired the land nor there is any project on the spot. Later, it was published only with the pre-launched letter. Later, the office of the opposite party was closed in March 2017 and has absconded from there. Then this complaint was filed on 07.06.2017.
5. The notice issued by this Commission in the complaint has been returned by the opposite party with the endorsement of either 'left', 'refused', 'unclaimed' or 'address left'. Thereafter, the notices were directed to be published and publication was done on the date 31.05.2019 in 'Times of India' and 'Vijaya Karnataka' newspapers having wide circulation in Bengaluru. This Commission thereafter, proceeded ex-parte against the opposite party by the order dated 28.11.2019 and the complainants filed their evidence.

Since the allegation made in the complaint has not been disputed/controverted by the opposite party and otherwise, it has been proved by the affidavit of evidence of the members of the complainant and the documents. Therefore, the allegations are taken to be correct. Since, after pre-launch notification, the complainants have deposited a substantial amount but the project is not being proceeded at all. Therefore, the complainants are entitled for refund of their money.
ORDER
In the result, the complaint is allowed. The opposite parties are directed to refund the money deposited by the complainants with interest @9% per annum from the date of respective deposit till the date of refund individually or severally within a period of three months from the date of producing a certified copy of this judgment upon opposite party no.1.
